Overcrowded wards, crumbling walls, poor ventilation, and inhuman living conditions persist across facilities like Ara District Prison, Gaya Central Prison and Correctional Home, and Buxar Central Prison and Correctional Home. In overcrowded facilities like those in Delhi and Haryana, the lack of ventilation turns cells into breeding grounds for infection.
However, a shift towards Open Institutions offers a humane and effective solution. By replacing high walls with sunlight and fresh air, these reformative spaces naturally combat the bacteria while restoring prisoner dignity. In WRIT PETITION (C) NO(S). 1082 OF 2020, the Supreme Court of India issued crucial directions to strengthen Open Correctional Institutions (OCIs) as instruments of dignity, reform, and reintegration. The Court highlighted gaps such as the absence of OCIs in several States and the under-utilisation of existing facilities. It directed States to assess feasibility, establish OCIs or create open and semi-open barracks, and develop time-bound protocols to fill vacancies.For Union Territories, the Court emphasised either setting up OCIs or enabling transfer of eligible prisoners to nearby institutions, while ensuring minimum reformative facilities within existing prisons. Monitoring Committees have been tasked with overseeing implementation and ensuring accountability.These directions reflect a shift from mere confinement to meaningful correction, ensuring that prisons uphold constitutional values and provide prisoners with opportunities for reform, dignity, and eventual reintegration into society.
