India’s Ministry of Power notified the Electricity (Amendment) Rules, 2026 on March 13, 2026, to reform regulations for captive power generating plants.Key Rules and ChangesCore Ownership: Captive users must hold at least 26% ownership in the power plant. Core Consumption: Captive users must consume at least 51% of the total electricity generated each year. Flexible Group Rules: The rules remove the old, strict individual proportionality formula (known as the Unitary Qualifying Ratio). Compliance is now calculated collectively for groups and special purpose vehicles. Energy Storage: Electricity routed through energy storage systems now counts toward valid captive consumption.Surcharge Protection: Power companies cannot charge extra interim surcharges while checking a plant’s captive status, as long as the user submits a formal declaration.
