*Uttarakhand Govt. recognised the unique Customs, Traditions and Laws of Scheduled Tribes and excluded them from Uniform Civil Code (UCC).*
The Uttarakhand state adopted the Uniform Civil Code on January 27, 2025. This landmark reform standardizes laws related to marriage, divorce, inheritance, and succession, promoting equality across gender and religion, excluding scheduled tribes.
Tribals were excluded from the Uniform Civil Code (UCC) for several historical, cultural, and political reasons:
1. *Distinct Cultural Identity*: Tribals have unique customs, traditions, and laws.
2. *Customary Laws*: Tribals have their own customary laws, which are not compatible with the UCC.
3. *Special Protection*: Constitution grants special protection and autonomy to tribals under the Fifth and Sixth Schedules.
4. *Fear of Cultural Homogenization*: UCC might lead to erosion of tribal cultural identities.
5. *Constitutional Exemptions*: Articles 244(1) and 371 exempt Scheduled Areas and certain states from general laws.
These factors have contributed to the exclusion of tribals from the UCC, allowing them to maintain their distinct cultural identities and customary practices.
Uttarakhand's adoption of the Uniform Civil Code (UCC) while respecting the cultural autonomy of Scheduled Tribes sets a significant precedent. It's indeed hoped that other states will follow suit, balancing the need for uniformity with the importance of preserving cultural diversity and autonomy.
