Various provisions of the Apartment Ownership Act & Rules, conditions of approval as in BRIII & LCIV-A are being violated by builders on a daily basis. Sale of projects without sanctioned layout plans.
2. Sale and Registry
of Super Area and not of Apartment Area / Dwelling Unit.
3. Illegal sale of Parking Area and Community Center as separate entities.
4. Claiming of exclusive rights over the common area and facilities before and after completion of project.
5. Illegal sale of Common Area and Facilities by your licensee.
6. Denial of transfer of land title to the Owners Association.
7. Denial of transfer of Administration and Management of Complexes to the Apartment Owners Association.
8. Not constructing nursery schools, dispensaries, etc. by the builders at their own cost, as defined in LC IV A.
9. As a custodian of various laws and acts related to Group Housing Societies, the role of Director of Town and Country Planning is not only limited to the extent of granting Licenses and Occupation Certificates but to ensure true implementation of these Laws and Acts in their spirit.
