On 5th May, the International Human Rights Council (IHRC), Sikkim State Office, received a written grievance from a woman asserting that she is the legally wedded wife of her husband, having solemnized the marriage both legally and traditionally approximately 19 years ago, following the demise of his first wife.

The complainant has alleged that for the past one and a half months, she has been unlawfully and forcefully prevented by her step-son from meeting her husband, who is presently in a critical medical condition. Such obstruction is not only inhumane but also constitutes a direct violation of her legal and marital rights.

The right of a legally wedded wife to have access to, care for, and attend to her husband—especially during a medical emergency—is protected under the principles of natural justice and relevant provisions of law. Any act of restraining or denying such access may attract serious legal consequences.

In view of the gravity of the matter, IHRC Sikkim State has formally escalated the complaint to the Sikkim State Women Commission, seeking immediate intervention and enforcement of the complainant’s legal rights.

We place on record our appreciation for the prompt cognizance and action taken by the Commission, including issuing necessary directions to the concerned individual to ensure compliance.

While maintaining confidentiality to protect the dignity of the individuals involved, IHRC wishes to categorically state that any continued denial of access to the complainant will compel this office to initiate appropriate legal proceedings under applicable laws and to bring the matter into the public domain through media, in the interest of justice and accountability.

This shall be treated as a matter of serious legal concern, and any further violation will not be tolerated.

Where are the so-called Gorkha leaders of Darjeeling? It is very disturbing to see a pregnant sister crying in front of the media after losing her brother in a hit-and-run case. This is not only heartbreaking but also a shameful situation reflecting the law and order condition in Darjeeling district.

We strongly appeal to all concerned authorities to take immediate action and ensure that the culprits are brought to justice. At the same time, we request all responsible citizens, organizations, and leaders to unite and support the victim’s family in this difficult time.

Let us stand together for justice and humanity. 🤝⚖️

On 11 January 2026, a 66-year-old senior citizen, Mr. Lal Bdr Shanker, resident of Dochum Khamdung Singtam Constituency, approached our office with a grievance regarding non-refund of his investment.

He stated that on 29 May 2012, he invested a sum of ₹35,000 (Rupees Thirty-Five Thousand) in the name of his wife , a company named Health Care (Sikkim) Pvt. Ltd. – Pheno Gold, having its office at 6th Mile, National Highway-31, Tadong, P.O. Samdur, Gangtok, Sikkim – 737101.
The investment was made for a period of nine (9) years and was scheduled to mature on 28 May 2021.

As per the Deed / Certificate of Membership issued by the company, the investor was eligible to receive the full maturity amount on the date of expiry of the membership, i.e., 28 May 2021. However, when Mr. Shanker attempted to claim his maturity amount, he found that the company office had already been closed and had disappeared.

For the last four years, Mr. Shanker has been continuously following up with the company’s agent, but despite repeated requests, no repayment has been made.

After hearing his grievance, I contacted the concerned agent for clarification. She informed that many investors, including herself and members of her family, have also been victims of the same company. She further stated that a legal case has been filed against the company and that efforts are being made to recover the investments of all victims.

I have therefore directed the agent to submit all relevant documents, including case details and supporting records, at the earliest, so that the facts can be verified and appropriate further action can be initiated.

This complaint has been taken on record for necessary follow-up in the interest of justice, especially considering that the complainant is a senior citizen.

As we welcome the New Year 2026, the International Human Rights Council, Sikkim State, extends its warmest greetings and best wishes to all the people of Sikkim and the nation.

The New Year is a time for reflection, renewal, and renewed commitment to the values that bind us as a just and compassionate society. As we step forward together, we reaffirm our unwavering dedication to the protection and promotion of human rights, human dignity, equality, and justice for all—especially for the most vulnerable sections of our society.

Sikkim has long been known for its peace, harmony, and rich cultural values. It is our collective responsibility to preserve these ideals by standing firmly against social evils such as violence against women and children, substance abuse, discrimination, and exploitation. The protection of the girl child, the safety of our youth, and the creation of a drug-free society must remain shared priorities for citizens, civil society, and the administration alike.

The International Human Rights Council, Sikkim State, looks forward to continued cooperation with the Government, law-enforcement agencies, civil society organizations, and concerned citizens to build a safer, more inclusive, and rights-respecting society in the coming year.

IHRC Felicitates Ms. Rajina Rai for Creating History at IRONMAN 70.3 Goa 2025

The International Human Rights Council (IHRC), Sikkim State, proudly announces the felicitation of Ms. Rajina Rai for her extraordinary and trailblazing achievement at IRONMAN 70.3 Goa 2025.

The felicitation was carried out by Mr. Sisir Gurung, District President (Youth Skills and Sports Department), IHRC, and Mr. Krish Kumar Shah, Joint Director, East District, IHRC, who presented Ms. Rai with a Letter of Appreciation in recognition of her remarkable accomplishment.

At just 20 years of age, Ms. Rajina Rai has etched her name in Sikkim’s sporting history by becoming the youngest and first-ever Sikkimese woman to successfully complete the challenging 1.9 km open-water swim, a crucial segment of the globally acclaimed IRONMAN 70.3 endurance race. Her feat stands as a testament to exceptional discipline, resilience, and dedication to sports excellence.

Ms. Rai is also a NIS-certified swimming coach, further highlighting her commitment to promoting sports and inspiring young athletes, especially women, to pursue excellence at national and international levels.

IHRC, Sikkim State, congratulates Ms. Rajina Rai on her historic achievement and wishes her continued success in her future sporting endeavors. The Council reaffirms its commitment to recognizing and encouraging individuals who bring pride and inspiration to the state and the nation.

Domestic Violence Case Follow-Up

On behalf of the Sikkim Youth Welfare Association (SYWA) and the International Human Rights Council, Sikkim State, we are following up on the domestic violence case registered at our office by Mrs. Phurkit Lepcha, a resident of Rokshey Kedanthang, East Sikkim.

A few days ago, we lodged an FIR regarding her missing husband, who has been untraceable since 17th August 2025.
Today, we have officially filed the case with the Sikkim State Women Commission, Gangtok, for further necessary action.

We firmly believe that the Commission will take appropriate steps to ensure justice and protection for Mrs. Lepcha and her children.

Clarification on the Complaint Filed by Mr. Silvester Rai Against Police Misconduct

The International Human Rights Council, East Sikkim, wishes to clarify recent queries from media representatives regarding the complaint submitted by Mr. Silvester Rai, a taxi driver from Pakyong, on 18 October 2025, alleging misconduct and harassment by a police officer in Gangtok.

Upon receiving the application, the Council acknowledged the complaint and initiated the process of preliminary assessment as per standard procedure. However, on 27 October 2025, Mr. Silvester Rai personally submitted a written application for the withdrawal of his earlier complaint, stating that the matter had been amicably resolved through mutual discussion and understanding between both parties.

In his withdrawal letter, Mr. Rai mentioned that there were no longer any grievances or misunderstandings, and he expressed his gratitude to the International Human Rights Council for its attention and assistance. The Council has officially closed the case from its records following the written request of the complainant.

The International Human Rights Council reiterates that it remains committed to upholding justice, fairness, and human dignity, and will continue to address genuine grievances brought before it in accordance with due process.

We appreciate the interest shown by members of the media and request that this clarification be noted as final update on the matter.
