Delhi , the capital city of India has turned into the most worst city as far as the safety of women is concerned. A large number of r**e cases are registered every year in Delhi. A study of the r**e cases reveals that most of the r**es are committed either by relatives or those who are very close to the victim. In spite of the existence of strict laws the frequency of r**e cases are still increasi
ng. However the legal provisions for r**e are at times misused also for some personal gains. Hence in order to vanish the evil of r**e we must be responsible towards our society and should also refrain us from the misuse of legal provisions. Recently an alleged ra**st has been acquitted by the Supreme Court in the case of Dinesh Jaiswal Vs State of Madhya Pradesh(12 January 2010). The fact that the victim was alone in her house and the accused was arrested from the victim’s house became the only basis for conviction by the trial court. It often happens that false r**e cases are made out by taking advantage of the strict legal provisions. A study of the aforesaid case will help us to understand this statement more clearly.
