ಕರ್ನಾಟಕ ಹೈಕೋರ್ಟ್ ಇತ್ತೀಚಿನ ತೀರ್ಪಿನಲ್ಲಿ, ಗಂಡನಿಗಿಂತ ಹೆಚ್ಚು ಗಳಿಸುವ ಮತ್ತು ಆರ್ಥಿಕವಾಗಿ ಸ್ವಾವಲಂಬಿಯಾಗಿರುವ ಪತ್ನಿಯರು ಮಧ್ಯಂತರ ಜೀವನಾಂಶ ಪಡೆಯಲು ಸ್ವಯಂಚಾಲಿತವಾಗಿ ಅರ್ಹರಲ್ಲ ಎಂದು ಸ್ಪಷ್ಟಪಡಿಸಿದೆ. ರವಿ ಎಸ್ @ ಜೀವನ್ ಎಸ್. ವರ್ಸಸ್ ಸಹನಾ ದೇವಿ ಎ. ಪ್ರಕರಣದಲ್ಲಿ ನ್ಯಾಯಮೂರ್ತಿ ಡಾ. ಚಿಲ್ಲಾಕೂರು ಸುಮಲತಾ ಅವರು ಕೆಳಹಂತದ ನ್ಯಾಯಾಲಯದ ಆದೇಶವನ್ನು ರದ್ದುಗೊಳಿಸಿದರು. ಏಕೆಂದರೆ, ಕೌಟುಂಬಿಕ ನ್ಯಾಯಾಲಯವು ಪತ್ನಿಯ ಆರ್ಥಿಕ ಸ್ಥಿತಿಯನ್ನು ಸಂಪೂರ್ಣವಾಗಿ ನಿರ್ಲಕ್ಷಿಸಿ, ಕೇವಲ ಪತಿಯ ಸಂಬಳವನ್ನು ಮಾತ್ರ ಪರಿಗಣಿಸಿತ್ತು.
ಜೀವನಾಂಶವನ್ನು ಹೇಗೆ ನಿರ್ಧರಿಸಬೇಕು ಎಂಬುದರ ಕುರಿತು ಹೈಕೋರ್ಟ್ ಪ್ರಮುಖ ಅಂಶಗಳನ್ನು ತಿಳಿಸಿದೆ.
ಜೀವನಾಂಶ ನಿರ್ಧರಿಸುವ ಪ್ರಮುಖ ಅಂಶಗಳುಆದಾಯದ ವ್ಯತ್ಯಾಸ: ಈ ಪ್ರಕರಣದಲ್ಲಿ ಪತ್ನಿಯ ಮಾಸಿಕ ಆದಾಯ ₹1 ಲಕ್ಷಕ್ಕೂ ಹೆಚ್ಚಿತ್ತು. ಆದರೆ ಪತಿಯ ಆದಾಯ ಸುಮಾರು ₹60,000 ಆಗಿತ್ತು.ಆರ್ಥಿಕ ಅಗತ್ಯತೆ.
ಜೀವನಾಂಶದ ಮೂಲ ಉದ್ದೇಶ ಆರ್ಥಿಕವಾಗಿ ತನ್ನನ್ನು ತಾನು ಸಾಕಿಕೊಳ್ಳಲು ಸಾಧ್ಯವಾಗದ ಸಂಗಾತಿಗೆ ಬೆಂಬಲ ನೀಡುವುದಾಗಿದೆ.ಮಕ್ಕಳ ಜವಾಬ್ದಾರಿ ಇಲ್ಲದಿರುವುದು.
ದಂಪತಿಗೆ ಯಾವುದೇ ಮಕ್ಕಳಿರಲಿಲ್ಲ. ಪತ್ನಿಯ ಮೇಲೆ ಯಾವುದೇ ಪ್ರಮುಖ ಕೌಟುಂಬಿಕ ಸಾಲದ ಹೊರೆ ಇರಲಿಲ್ಲ.
ಲಿಂಗ ತಾರತಮ್ಯಕ್ಕೆ ಆಸ್ಪದವಿಲ್ಲ.
ಜೀವನಾಂಶವನ್ನು ಕೇವಲ ಲಿಂಗದ ಆಧಾರದ ಮೇಲೆ ನೀಡಲಾಗುವುದಿಲ್ಲ. ಅದನ್ನು ಆರ್ಥಿಕ ಅಗತ್ಯತೆ ಮತ್ತು ಇಬ್ಬರ ಆದಾಯದ ಸಾಮರ್ಥ್ಯದ ಮೇಲೆ ನಿರ್ಧರಿಸಬೇಕು ಎಂದು ಕೋರ್ಟ್ ಹೇಳಿದೆ.
ಕೆಲಸ ಮಾಡದೆ ಸುಮ್ಮನೆ ಕುಳಿತುಕೊಳ್ಳುವ ಸಂಗಾತಿಯ ಕುರಿತು ಸ್ಪಷ್ಟನೆವಿಚ್ಛೇದನ ಅಥವಾ ಪ್ರತ್ಯೇಕತೆಯ ನಂತರ ಕೆಲವು ಸಂಗಾತಿಗಳು ಉದ್ದೇಶಪೂರ್ವಕವಾಗಿ ಕೆಲಸ ಮಾಡದೆ ಖಾಲಿ ಕುಳಿತುಕೊಳ್ಳುವ ಪ್ರವೃತ್ತಿಯನ್ನು ನ್ಯಾಯಾಲಯವು ತೀವ್ರವಾಗಿ ಟೀಕಿಸಿದೆ. ಉತ್ತಮ ಆರೋಗ್ಯ ಹೊಂದಿರುವ ಮತ್ತು ಈ ಹಿಂದೆ ಕೆಲಸದ ಅನುಭವ ಇರುವ ವ್ಯಕ್ತಿಯು, ಸುಮ್ಮನೆ ಕುಳಿತುಕೊಂಡು ಸಂಗಾತಿಯಿಂದ ಪೂರ್ಣ ಪ್ರಮಾಣದ ಜೀವನಾಂಶವನ್ನು ನಿರೀಕ್ಷಿಸುವಂತಿಲ್ಲ.
ಪ್ರತಿಯೊಬ್ಬರೂ ತಮ್ಮ ಜೀವನೋಪಾಯಕ್ಕಾಗಿ ಸೂಕ್ತ ಪ್ರಯತ್ನ ಮಾಡುವುದು ಕಾನೂನುಬದ್ಧ ಬಾಧ್ಯತೆಯಾಗಿದೆ. ಸೂಕ್ತ ಕಾರಣವಿಲ್ಲದೆ ಕೆಲಸ ಮಾಡದಿದ್ದರೆ, ಅವರು ಕೇವಲ ಸಣ್ಣ ಪ್ರಮಾಣದ ಬೆಂಬಲವನ್ನು ಪಡೆಯಬಹುದೇ ಹೊರತು ಇಡೀ ಜೀವನದ ಖರ್ಚನ್ನಲ್ಲ ಎಂದು ನ್ಯಾಯಾಲಯ ಸ್ಪಷ್ಟಪಡಿಸಿದೆ.
The Karnataka High Court ruled that financially independent wives who earn more than their husbands are not automatically entitled to routine interim maintenance. In the case of Ravi S @ Jeevan S. v. Sahana Devi A. (decided on 18 June 2026), Justice Dr. Chillakur Sumalatha set aside a lower court order because the trial court had evaluated the husband's salary while completely overlooking the wife's economic status.

No Child Dependents: The couple did not have any children, and the wife had no major, documented marital debts or liabilities.

Clarification on Idle SpousesThe court also heavily criticized the practice of spouses remaining purposefully unemployed after separation. The bench observed that an able-bodied person with previous work experience cannot simply sit idle and expect total maintenance from their partner. Spouses are legally obligated to make reasonable efforts toward their own livelihood. In cases where a spouse chooses not to work without a valid reason, they are only eligible to seek minor, supportive maintenance rather than an entire livelihood package.
