When a public authority fails to perform a legal duty, a Writ of Mandamus may help.

“Mandamus” means “We Command.” Under Article 226 of the Constitution, High Courts can direct public authorities to perform duties imposed by law.

For example, if an authority keeps a legally valid application pending without taking a decision, a person may approach the High Court for a direction to decide it according to law.

However, mandamus does not automatically guarantee the outcome sought. The key is a legal right and a corresponding public duty.

It is also not always the first remedy where an effective statutory appeal exists, though exceptions may apply, such as violations of natural justice.

Mandamus enforces legal duty, not a preferred result.

Public Interest Litigation (PIL) is a legal action filed to protect the interests of the public or a disadvantaged group.

It can be filed by any public-spirited person or organization, even if they are not personally affected.

In Bandhua Mukti Morcha v. Union of India, the Supreme Court protected bonded labourers. In M.C. Mehta v. Union of India, PILs addressed environmental protection.

The Protection of Children from Sexual Offences (POCSO) Act applies even when a minor is married under personal law.

Marriage does not provide an exception to the protection given to children under POCSO. Section 42A further provides that POCSO will prevail if there is any inconsistency with another law.

The Kerala High Court has held that sexual offences against a minor spouse can attract POCSO provisions and denied bail to the husband, reinforcing the overriding protection given to children.

Today, the Dhwani Legal Trust team and interns came together for an insightful internal session on mental health, well-being, and building healthier ways of navigating the demands of our work.

We’re grateful to Dr. Lekshmi Vimala, M.Phil & Ph.D. in Psychiatric Social Work, NIMHANS, for leading the session and sharing her expertise with our team. It was aa wonderfully held session, thoroughly informative and enjoyable.

Because caring for the work also means caring for the people who do it. 🌱

In India, mutual consent divorce is available to both Christian and Muslim couples, but the legal process differs.

Unlike Hindu couples, who generally seek mutual-consent divorce through the Hindu Marriage Act, Christian couples may seek divorce by mutual consent under the Divorce Act, 1869, subject to applicable conditions and court procedure.

Muslim couples may dissolve their marriage mutually through Mubarat, where both spouses agree to separate, subject to the applicable Muslim personal law and legal requirements.

The appropriate procedure depends on how the marriage was solemnized and the laws governing the spouses.

The Supreme Court, through Justices P S Narasimha and A S Chandurkar, held that the right to walk is a fundamental right under Articles 19(1)(d) and 21 of the Constitution.

The case arose after a five-year-old boy was fatally struck by a tanker while walking to school on a road without a footpath or pedestrian crossing.

The Court ruled that authorities have an enforceable duty to provide and maintain demarcated footpaths.

Violation of this right should entitle citizens to constitutional remedies, restitution, and compensation.

The appellant in this case was awarded ₹11.44 lakh as compensation.

The Karnataka Apartment (Ownership and Management) Bill, 2026 is a recent proposal aimed at creating a clearer and more uniform framework for apartment ownership and management in Karnataka

It covers individual apartment ownership, common areas, apartment associations, maintenance, redevelopment and dispute resolution.

The Bill was passed by the Karnataka Legislative Assembly in August 2026 and subsequently by the Legislative Council.

It still requires the Governor’s assent and commencement notification before becoming enforceable law.
