DRINGENDER ANTRAG AUF EINLEITUNG EINES ERMITTLUNGS- UND AUFSICHTSVERFAHRENS GEGEN DIE PARTEI „MERA25“ WEGEN VERDACHTS AUF VOLKSVERHETZUNG, EXTREMISTISCHE PROPAGANDA, VERLEUMDUNG GEWÄHLTER AMTSTRÄGER UND GEFÄHRDUNG DER DEMOKRATISCHEN GRUNDORDNUNG

1. Antragsteller

2. Gegenstand des Antrags

Hiermit stellen wir den dringenden Antrag auf:

a) Einleitung eines strafrechtlichen Ermittlungsverfahrens

gegen Verantwortliche der politischen Partei MERA25 wegen u. a.:
• Volksverhetzung (§ 130 StGB)
• Verleumdung (§ 187 StGB)
• Übler Nachrede (§ 186 StGB)
• Öffentlicher Angriff auf Repräsentanten demokratischer Institutionen
• Gefährdung der öffentlichen Ordnung
• Verbreitung extremistischer Narrative

b) Einleitung eines parteiaufsichtsrechtlichen Verfahrens

durch die Bundeswahlleitung, insbesondere wegen:
• Verdacht auf systematische demokratiefeindliche Agitation
• Missbrauch des Parteienstatus zur Verbreitung extremistischer Inhalte
• Unklarer Verantwortungsstrukturen und Finanzen
• Verdacht auf gesteuerte politische Einflussnahme aus dem Ausland

c) Offenlegung sämtlicher Verantwortlichen

(Parteiführung, Redakteure, Social-Media-Betreiber, Finanziers und Kampagnenverantwortliche) der Partei MERA25 nach Parteiengesetz und Strafprozessordnung.

3. Begründung

Die Partei MERA25 verbreitet öffentlich – insbesondere über Facebook, Instagram, TikTok und YouTube – politische Inhalte, die in mehrfacher Hinsicht strafrechtlich relevant und gesellschaftlich hochgefährlich erscheinen.

Anlass dieses Antrags sind mehrere jüngst veröffentlichte Beiträge der Partei, in denen u. a.:

– demokratisch gewählte deutsche Amtsträger als „Kriegsverbrecher“ diffamiert werden,

ohne jegliche Tatsachengrundlage.

– der israelische Premierminister in verleumderischer Weise kriminalisiert wird,

wobei eindeutig extremistisches Vokabular verwendet wird.

– Deutschland und Israel als „blutige Komplizen“ dargestellt werden,

was klare Elemente der modernen antisemitischen Delegitimierung erfüllt.

– ein angeblicher „Genozid“ behauptet wird,

obwohl dies faktisch wie juristisch unhaltbar ist und einzig der Emotionalisierung und Radikalisierung dient.

Die Wortwahl, die systematische Verbreitung falscher Tatsachenbehauptungen und die agitatorische Aufladung erfüllen nach juristischer Bewertung den Anfangsverdacht mehrerer Straftatbestände und stellen einen schwerwiegenden Angriff auf:
• die freiheitlich-demokratische Grundordnung,
• die außenpolitische Sicherheit Deutschlands,
• den gesellschaftlichen Frieden,
• den Schutz jüdischen Lebens und israelischer Staatsbürger.

4. Forderungen

Wir beantragen daher:

1. Einleitung eines umfassenden strafrechtlichen Ermittlungsverfahrens gegen alle Verantwortlichen der Partei MERA25.

2. Sofortige Einbestellung der Partei zur Offenlegung von:
• Verantwortlichen Personen
• Kommunikationsstrukturen
• Social-Media-Teams
• Finanzen und Geldquellen
• internationalen Verbindungen

3. Prüfung eines parteienrechtlichen Verbotsverfahrens, falls sich der Verdacht extremistischer Bestrebungen erhärtet.

4. Einstufung der aktuellen Veröffentlichungen als verfassungsfeindliche und radikalisierende Inhalte.

5. Koordination mit Strafverfolgungsbehörden der Bundesländer, insbesondere Staatsschutz, LKA und BKA.

5. Dringlichkeit

Die veröffentlichten Beiträge erzeugen:
• einen erheblichen Schaden an der demokratischen Meinungsbildung,
• eine wachsende Radikalisierung junger Zielgruppen,
• eine Gefährdung jüdischer Bürger,
• eine Delegitimierung der deutschen Staatsorgane.

Es besteht unmittelbarer Handlungsbedarf.

6. Schlussbemerkung

Wir ersuchen um schriftliche Bestätigung des Eingangs sowie Mitteilung der eingeleiteten Maßnahmen.

2. Subject of the Request

We hereby submit an urgent request for:

a) Initiation of a criminal investigation

against the responsible persons of the political party MERA25, including but not limited to the following suspected offences:
• Incitement to hatred (§ 130 German Criminal Code)
• Defamation (§ 187 StGB)
• Slander (§ 186 StGB)
• Public attacks on representatives of democratic institutions
• Endangerment of public order
• Dissemination of extremist narratives

b) Initiation of supervisory proceedings under the Political Parties Act

by the Federal Returning Officer, particularly due to:
• Suspected systematic anti-democratic agitation
• Misuse of party status to disseminate extremist content
• Lack of transparency regarding responsible persons and financial structures
• Suspicion of foreign-directed political influence

c) Disclosure of all persons responsible

including party leadership, editorial staff, social media operators, financiers, and campaign coordinators, as required under the Political Parties Act and the Code of Criminal Procedure.

3. Reasoning

The political party MERA25 has been publicly disseminating—especially via Facebook, Instagram, TikTok, and YouTube—political content that appears highly dangerous to public order and clearly relevant under German criminal law.

Recent posts published by MERA25 include:
• Defamation of democratically elected German officials as “war criminals,”
without any factual or legal basis.
• Criminalisation of the Israeli Prime Minister
through manipulative and extremist rhetoric.
• Representation of Germany and Israel as “bloody accomplices,”
fulfilling key indicators of modern antisemitic delegitimisation.
• False allegations of an ongoing “genocide,”
which are factually and legally unsubstantiated and serve solely to incite and radicalise the public.

The language, the systematic spread of false allegations, and the agitational framing fulfil the legal threshold of several criminal offences and constitute a severe attack on:
• the free democratic constitutional order,
• the foreign policy interests of the Federal Republic of Germany,
• social peace,
• the safety of Jewish citizens and Israeli nationals.

4. Requests

We therefore request:

1. Initiation of a comprehensive criminal investigation

against all persons responsible for MERA25.

2. Immediate summons of the party to disclose:
• responsible individuals
• organisational communication structures
• social media management teams
• sources of funding and financial flows
• international affiliations

3. Examination of whether party prohibition proceedings should be initiated

in case evidence of anti-democratic extremist activity is confirmed.

4. Classification of the published content as unconstitutional, extremist, and radicalising.

5. Coordination with state-level law enforcement,

including State Security, regional Criminal Investigation Offices (LKA), and the Federal Criminal Police Office (BKA).

5. Urgency

The contents published by MERA25 cause:
• significant damage to democratic political discourse,
• increasing radicalisation of younger audiences,
• heightened danger for Jewish communities,
• delegitimisation of German state institutions.

Immediate action is required.

6. Conclusion

We ask for written confirmation of receipt and for notification of all measures initiated in response to this request.

2. Anlass des Auskunftsersuchens

Am 08.12.2025 veröffentlichten deutsche Medien, darunter Bild (regional Hessen), Berichte über eine Person, die dort als:

„Charifa B.“

bezeichnet wird und die:
• an der Hochschule Darmstadt studieren soll,
• 23 Jahre alt sei,
• sich gemäß Berichterstattung in israelfeindlichen, bis hin zu Hamas-nahen Strukturen engagiere,
• auf sozialen Medien u. a. Fotos von Hamas-Führern geteilt habe,
• an der Hochschule mit einer ca. 50 cm langen Waffenattrappe posiert habe.

Diese Vorgänge sind für unsere Organisation von hoher sicherheitsrelevanter Bedeutung, da international koordinierte Hamas-Unterstützung im universitären Bereich – besonders in Deutschland – dokumentiert werden muss.

Für die Einstufung des Vorfalls, seine Relevanz für laufende israelische Sicherheitsverfahren und mögliche internationale Rechtshilfeersuchen ist eine zweifelsfreie Identitätsfeststellung erforderlich.

3. Antrag

Hiermit beantragen wir gemäß § 4 Abs. 1 IFG Hessen, flankiert von § 1 HDSIG sowie Art. 10, 11 EU-DSGVO (Ausnahmen im Rahmen öffentlicher Sicherheitsinteressen):

Auskunft über folgende Punkte:
1. Vollständiger Name der Person, welche in den Medien als
„Charifa B.“ bezeichnet wird.
2. Bestätigung, ob die genannte Person tatsächlich an der
Hochschule Darmstadt immatrikuliert ist oder war.
3. Mitteilung, ob gegen die Person aktuell ein
Ermittlungsverfahren bei der Staatsanwaltschaft Darmstadt geführt wird.
4. Rechtliche Einordnung der Vorwürfe, insbesondere im Hinblick auf
§§ 129a/b StGB (Bildung/Unterstützung terroristischer Vereinigungen),
§ 111 StGB (Öffentliche Aufforderung zu Straftaten),
§ 140 StGB (Billigung von Straftaten).
5. Bewertung, ob von der Person eine sicherheitsrelevante Gefahr
ausgeht, welche eine Mitteilung an ausländische Behörden legitimiert (Art. 49 Abs. 1 lit. d DSGVO).

4. Rechtsgrundlage und zwingendes öffentliches Interesse

Die OAHI ist als internationale Dokumentations- und Rechtsstelle tätig und arbeitet regelmäßig in multinationalen Verfahren zur Terrorismus- und Extremismusbekämpfung mit Partnerbehörden zusammen.

Ein überwiegendes öffentliches Interesse an Transparenz besteht aufgrund:
• der mutmaßlichen Nähe zu einer international als terroristisch eingestuften Organisation (Hamas),
• der sicherheitsrelevanten Bedeutung extremistischer Aktivitäten an deutschen Hochschulen,
• der Notwendigkeit, antisemitisch motivierte Radikalisierung zu dokumentieren,
• der möglichen Gefährdung jüdischer Studierender und israelischer Staatsbürger in Deutschland.

2. Background of the Information Request

On 08 December 2025, German media outlets, including Bild (regional edition Hessen), published reports regarding an individual publicly referred to as:

“Charifa B.”

According to these reports, the individual:
• is said to be 23 years old,
• is allegedly enrolled at Darmstadt University of Applied Sciences,
• is reportedly active in anti-Israel and potentially Hamas-affiliated circles,
• has posted photographs of Hamas leaders on social media,
• and posed at the university with a 50-cm replica weapon.

These incidents are of substantial security relevance to our organization, particularly in light of internationally coordinated Hamas-support activities within academic institutions in Germany.

For the legal classification of the case, its relevance to ongoing Israeli security assessments, and potential international mutual legal assistance procedures, unambiguous identification of the individual is required.

3. Request

Pursuant to § 4 (1) IFG Hessen, supported by § 1 HDSIG and Articles 10 and 11 of the EU GDPR (exceptions in cases of public security interests), we hereby request:

Disclosure of the following information:
1. The full legal name of the person publicly referred to as “Charifa B.”
2. Confirmation whether this individual is or was enrolled at Darmstadt University of Applied Sciences.
3. Clarification whether the individual is currently the subject of an ongoing investigation by the Public Prosecutor’s Office Darmstadt.
4. Legal assessment of the publicly reported allegations, in particular with regard to:
• §§ 129a/b German Criminal Code (forming/supporting terrorist organizations),
• § 111 German Criminal Code (public incitement to crime),
• § 140 German Criminal Code (condoning criminal acts).
5. An evaluation of whether the individual poses a security-relevant threat, thereby justifying disclosure to foreign authorities under Art. 49 (1) lit. d GDPR.

OAHI operates as an international documentation and legal body and routinely cooperates with governmental institutions in the investigation and monitoring of extremist and terrorist activity.

There is an overriding public interest in transparency due to:

OAHI – Organisation Against Hate Israel,
einer internationalen Stelle zur Dokumentation, Analyse und juristischen Verfolgung antisemitischer Hasspropaganda, extremistischer Narrative und verzerrter Medienberichterstattung gegen Israel und jüdische Gemeinschaften weltweit.

2. Gegenstand dieses Schreibens

Hiermit erstatten wir Strafanzeige sowie Strafantrag gegen:
• die verantwortlichen Redakteurinnen und Redakteure des genannten Tagesschau-Artikels,
• die Chefredaktion,
• die Programmleitung,
• die Intendanz der ARD,

wegen folgender potentieller Straftatbestände:

a) Verdacht der Verbreitung manipulativer bzw. einseitiger Inhalte

(§§ 130, 131, 189 StGB analog im Kontext extremistischer Meinungsbildung)

b) Verdacht der fahrlässigen oder vorsätzlichen Förderung extremistischer Narrative

durch selektive, verzerrte oder irreführende Darstellung ohne Berücksichtigung zwingender Fakten.

c) Verdacht der Rufschädigung israelischer Staatsbürger & Institutionen

d) Verdacht der Verletzung der journalistischen Neutralitätspflicht

gemäß Rundfunkstaatsvertrag, § 6 MStV (Ausgewogenheit & journalistische Sorgfalt).

e) Verdachtsmomente einer möglichen unzulässigen politischen oder finanziellen Einflussnahme Dritter

3. Sachverhalt

Im am 13.03.2025 veröffentlichten Artikel der Tagesschau wurden schwerwiegende Vorwürfe gegen den Staat Israel verbreitet, welche:
• ohne Beweisführung,
• ohne objektiven Kontext,
• ohne Gegenposition,
• ohne Erwähnung der Massaker und systematischen Vergewaltigungen der Hamas am 7. Oktober 2023

dargestellt wurden.

Dies erfüllt nach unserer fachlichen Bewertung die Voraussetzungen einer manipulativen Darstellung.

Durch die explizite Ausblendung der dokumentierten Hamas-Verbrechen entstand der Eindruck:
• einer Parteinahme,
• einer Verharmlosung terroristischer Gewalt,
• einer Täter-Opfer-Umkehr.

Dies stellt nicht nur einen journalistischen Pflichtverstoß, sondern potentiell eine Unterstützung extremistischer Narrative dar.

4. Ermittlungsbitte

Wir fordern hiermit die umgehende Eröffnung von Ermittlungen gegen:
• die verantwortlichen Redakteurinnen und Redakteure,
• die Redaktionsleitung,
• die Chefredaktion von ARD-aktuell,
• die Intendanz der ARD.

Es ist zu prüfen:

a) Ob journalistische Sorgfaltspflichten missachtet wurden.

b) Ob bewusst oder fahrlässig pro-terroristische Narrative begünstigt wurden.

c) Ob mögliche externe Einflussnahmen (politischer oder finanzieller Art) vorliegen.

d) Ob der 7. Oktober vorsätzlich ausgelassen wurde, um die Darstellung zugunsten terroristischer Gruppen zu verzerren.

5. Unterlassungsaufforderung

Wir fordern die ARD hiermit auf:
• sofort jede Form verzerrter, unvollständiger oder manipulativer Darstellung in Bezug auf Israel zu unterlassen,

Criminal complaint and request for prosecution due to biased, manipulative and potentially extremist reporting, violation of journalistic neutrality obligations, reputational harm to Israeli citizens, and indications of potential unlawful political influence

1. Mandate

We act on behalf of and under the authority of
OAHI – Organisation Against Hate Israel,
an international body dedicated to the documentation, analysis, and legal pursuit of antisemitic hate propaganda, extremist narratives, and distorted media reporting directed against Israel and Jewish communities worldwide.

2. Purpose of this Notice

We hereby file a criminal complaint and a formal request for prosecution against:
• the responsible editors of the referenced Tagesschau article,
• the editorial management,
• the programming leadership,
• the ARD executive management,

on the basis of the following potential criminal violations:

a) Suspicion of disseminating manipulative or one-sided content

(analogous application of §§ 130, 131, 189 German Criminal Code in the context of extremist influence)

b) Suspicion of negligent or intentional promotion of extremist narratives

through selective, distorted, or misleading reporting without consideration of essential facts.

c) Suspicion of reputational harm to Israeli citizens and institutions

d) Suspicion of violating journalistic neutrality and due diligence

pursuant to the Interstate Media Treaty (Medienstaatsvertrag), § 6 MStV.

e) Indications of potential unlawful political or financial influence by third parties

(legally formulated as: “Request for examination of possible external influence by non-state actors or foreign interest groups.”)

3. Factual Background

In the article published by Tagesschau on 13 March 2025, severe allegations were presented against the State of Israel which were:
• without evidentiary substantiation,
• without objective contextualisation,
• without inclusion of counterpositions,
• without any mention of the Hamas massacres and systematic sexual violence on 7 October 2023.

These omissions, combined with the selective portrayal of unverified accusations, meet the criteria of manipulative reporting.

By deliberately excluding well-documented Hamas atrocities, the report creates the appearance of:
• partisanship,
• minimisation or trivialisation of terrorist violence,
• a reversal of victim and perpetrator roles.

Such conduct constitutes not only a violation of fundamental journalistic duties but also a potential contribution to extremist and antisemitic narratives.

4. Request for Immediate Investigation

We hereby request the immediate initiation of criminal and administrative investigations into:
• the responsible editors,
• the editorial leadership,
• the editor-in-chief of ARD-aktuell,
• the ARD executive management.

The investigation must determine:

a) Whether journalistic due diligence obligations were breached.

b) Whether extremist or pro-terrorist narratives were knowingly or negligently promoted.

c) Whether unlawful external influence (political or financial) may have occurred.

d) Whether the omission of the 7 October Hamas atrocities was deliberate and intended to distort public perception in favour of terrorist organisations.

5. Cease-and-Desist Demand

We hereby demand that ARD:
• immediately cease any distorted, incomplete, or manipulative reporting concerning Israel,
• review and assess all internal editorial processes,
• publish a public clarification and corrective statement,
• fully disclose the selection of experts, sources, and verification methods used in the disputed report.

6. Closing Statement

Given the sensitive geopolitical context and the unprecedented wave of antisemitism in Europe, the responsibility of Germany’s public broadcasters is of the highest magnitude.

OAHI will closely monitor the investigative process and reserves the right to take further national and international legal action.
