Statement — In Defense of the Millennium-Old Rights of the Armenians and the Patriarchate of Jerusalem

The Central Council of the Armenian Revolutionary Federation (ARF) warmly welcomes the decision of the General Assembly of the Brotherhood of the Saints James on September 24, 2025, which declares the lease contract signed in 2021 for Goverou Bardez (Armenian Gardens) to be “illegal, anti-canonical, and void,” and rejects the “Addendum and the Regulatory Agreement” acquired through arbitration.

With these decisions, the Brotherhood reaffirms its commitment and legal obligation to manage Armenian-owned lands in Jerusalem for the benefit of the Armenian community.

We repeat that the resolution of this issue must be carried out exclusively on the basis of local and international law — without use of force or threat of doing so. The matter of Armenian rights in Jerusalem concerns the whole Armenian community; hence, any attempt to violate those rights is subject to a correspondingly communal response.

The Central Council of ARF’s Armenian Cause continues, by all possible means and in cooperation with the global Armenian Cause network, to stand in support of the Armenian community in Jerusalem and the Armenian Patriarchate in defending their millennium-old rights.

Սրբոց Յակոբեանց Միաբանական Ընդհանուր Ժողով – ԺԵ նիստ

Սրբոց Յակոբեանց Միաբանութեան Ընդհանուր Ժողովը գումարուեցաւ 24 Սեպտեմբեր, 2025ին, Պատրիարքարանի Դահլիճին մէջ։ Ժողովը բացուեցաւ աղօթքով՝ նախագահութեամբ Ամենապատիւ Տ. Նուրհան Արքեպիսկոպոս Մանուկեանի, Հայ Պատրիարքին Երուսաղէմի։ Միաբանութեան անդամներէն ներկայ գտնուեցան 28 միաբանակից հայրեր։

Իր պատգամին մէջ, Պատրիարք Սրբազան Հայրը խրախուսեց միաբանակից եղբայրներուն՝ «հաւատարմօրէն կապուած մնալ Սուրբ Աթոռին՝ անսասան սիրով եւ եղբայրական միաբանութեամբ, եւ բոլոր մարտահրաւէրները դիմագրաւել միասնաբար»։

Ժողովը նիստերը ամբողջութեամբ յատկացուց «Կովերու Պարտէզ(Հայոց Պարտէզ)»ի կալուածի խնդրոյ առարկայ վարձակալութեան։ Կալուածոց Տեսուչ՝ Կորիւն Սրբազան եւ Պատրիարքարանի իրաւաբանական խորհրդատուները մանրամասն ներկայացուցին 2021ի պայմանագրի պատմականը, յաջորդած դատական ընթացքը եւ հաշտարարի կողմէ ներկայացուած յաւելուածը եւ կարգաւորման համաձայնագիրը։ Երեկոյեան Նիստին ներկայացուեցան մանրամասնութիւններ համայնքին դատական գործընթացէն եւ տեսակէտները։

Երկար ու խորունկ քննարկումներէ ետք, առաջարկուեցաւ մերժել ներկայացուած յաւելուածը եւ կարգաւորեալ համաձայնագիրը եւ վերահաստատել Ընդհանուր Ժողովի կանոնական եւ բացառիկ իշխանութիւնը։

Քննարկումներէ ետք, Միաբանական Ընդհանուր Ժողովը մեծամասնութեամբ ՈՐՈՇԵՑ․

1. Վերահաստատել 27 Հոկտեմբեր, 2021 եւ 15 Նոյեմբեր, 2021, Միաբան Հայրերու յայտարարութիւնները, որոնք դատապարտած էին այս գործարքը իբրեւ անօրինական։

2. Յայտարարել 8 Յուլիս, 2021-ի Կովերու Պարտէզի պայմանագիրը, անօրինական, հակականոնական եւ անվաւեր, քանի որ եղած էր առանց Ընդհանուր Ժողովի վաւերացման։

3. Մերժել հաշտարարի միջոցաւ ձեռք բերուած Յաւելուածը (Addendum) եւ Կարգաւորման Համաձայնագիրը (Settlement Agreement)։

4. Նշանակել հինգ հոգեւորականներէ բաղկացեալ յանձնախումբ, որպէսզի փաստաբաններու հետ խորհրդակցաբար հետապնդեն չեղարկման դատական հայցն ընդդէմ «Զանա Կարտընս» ընկերութեան։

General Assembly of the Brotherhood of Sts. James – XVth Session

The General Assembly of the Brotherhood of Sts. James was convened on September 24, 2025, in the Assembly Hall of the Armenian Patriarchate of Jerusalem. The meeting opened with prayer under the presidency of His Beatitude Archbishop Nourhan Manougian, the Armenian Patriarch of Jerusalem. Twenty-eight members of the Brotherhood were present.

In his address, His Beatitude encouraged the brethren “to remain faithfully attached to the Holy See with unwavering love and fraternal solidarity, and to face all challenges together in unity.”

The Assembly dedicated its sessions entirely to the issue of the lease of the “Cows’ Garden (Armenian Garden)” property. The Director of Real Estate Bishop Koryun Baghdasaryan and the Patriarchate’s legal counsel presented in detail the background of the 2021 contract, the subsequent judicial proceedings, and the Settlement and Addendum proposed through mediation. In the evening session, further details were presented concerning the legal process and perspectives of the Armenian Community. After lengthy and in-depth deliberations, it was proposed to reject the Addendum and Settlement Agreement, and to reaffirm the canonical and exclusive authority of the General Assembly.

After discussions, the General Assembly of the Brotherhood, by majority decision REAFFIRMED;

1. The declarations of October 27, 2021, and November 15, 2021, by the Brotherhood Members, which condemned the transaction as illegal.

2. That the Lease Agreement concerning the “Cows’ Garden” signed on July 8, 2021, is illegal, uncanonical, and null and void, as it was signed without the approval of the General Assembly.

3. To reject the Addendum and the Settlement Agreement obtained through mediation.

4. AND appointed a committee of five clergymen to work in consultation with the legal counsel in continuing the cancellation lawsuit against “Xana Gardens” Ltd..
