Dublin R**e Crisis Centre gave thanks to all the incredible women who talked to Kieran Cuddihy today on RTÉ Radio 1 Liveline and shared their very personal and raw experiences of the criminal justice system after reporting a r**e or sexual assault.
They described the retraumatisation of the process and how it felt like they were the ones on trial, with their own counselling notes being weaponised against them and their most private thoughts being seen by others, including the accused person.
Some described how life-saving therapy was for them after their experience and so how dreadful it was that this place of safety and healing was being mined for evidence.
They just want the system to be rebalanced such that survivors are not retraumatised for seeking the justice that is rightfully theirs, and that no-one has to choose between counselling and court.
Dublin R**e Crisis Centre is seeking amendments to the Criminal and Civil Law Bill so that there is a presumption in law that counselling notes will NOT be disclosed – this would mean that they become legally privileged and the routine access to these confidential notes ends.
