[INDONESIA’S INVESTMENT CRISIS THROUGH THE LENS OF INTERNATIONAL INVESTMENT LAW]

In 2026, Indonesia faced serious economic pressure marked by the depreciation of the rupiah, capital outflows, and a sharp decline in the IHSG. These developments reflect not only market instability, but also deeper concerns regarding investor confidence, regulatory predictability, and legal certainty. In international investment law, legal certainty is a fundamental principle that allows investors to anticipate legal consequences, plan long-term investments, and operate within a stable regulatory environment. When regulations overlap, bureaucratic discretion becomes excessive, or policy direction appears unclear, investment risks increase and investors may choose to withdraw or relocate their capital.

Indonesia’s current investment challenges therefore highlight the urgent need for reforms that strengthen transparency, policy coherence, and institutional accountability. Cases such as fiscal uncertainty surrounding large-scale government programs and the withdrawal of LG Energy Solution demonstrate how investors assess not only economic opportunities, but also regulatory reliability and long-term policy consistency. Drawing from international best practices such as UNCTAD’s Investment Policy Framework and OECD guidelines, Indonesia must prioritize predictable regulation, harmonized investment rules, effective dispute resolution, and stronger anti-corruption measures. Ultimately, strengthening legal certainty is not merely a legal reform agenda, but an economic necessity to restore investor confidence and support Indonesia’s long-term development.

[Rupiah Tembus 18 Ribu: Menakar Dampak dan Efektivitas Hukum Moneter Indonesia]

The continuous depreciation of the Rupiah, which recently breached the level of Rp18,028 per US dollar, marks a critical juncture for Indonesia’s economic stability. Driven by a complex combination of global pressures, such as high US Treasury yields and geopolitical tensions, as well as domestic structural vulnerabilities, this trend poses a significant challenge to the nation’s fiscal and monetary frameworks.
This phenomenon underscores the urgency of examining the robustness of Indonesia’s monetary laws, particularly regarding the independence and coordination of Bank Indonesia post-ratification of the P2SK Law. While various strategic responses are being debated by policymakers and macroeconomists alike, the situation serves as a stark reminder that market confidence heavily relies on institutional integrity, law enforcement, and sustainable fiscal discipline.
