🔈【呼籲僱主與外傭理性溝通 ⚖️ 網上發言須負法律責任】
近日,國際家政服務業持續發展聯會(下稱「本會」)留意到,坊間及各大網絡平台上關於外傭政策及勞資關係的討論日益熱烈。
我們充分理解廣大僱主對完善外傭政策的殷切期盼,惟部分網絡言論漸趨偏激,甚至演變成互相謾罵與人身攻擊,本會對此深表關注。
聘用外傭是無數香港家庭維持日常運作的支柱,勞資雙方在生活習慣與期望上偶有落差,產生情緒實屬常情。然而,本會必須善意提醒:言論自由是香港的核心價值,但行使權利時絕不能凌駕於法律之上。網絡世界並非法外之地,🚫任何以「人權」或「言論自由」為名、行違法之實的過激言論,均無法獲得免責,並可能衍生嚴重的法律後果。
為保障廣大僱主及市民的自身權益,避免因一時情緒被挑撥而誤墮法網,本會特此重申,在網絡平台發表言論時須嚴格遵守香港現行法律,切勿觸碰以下法律紅線🚫:
⚖️ 1. 《種族歧視條例》:避免發表帶有種族中傷、騷擾或歧視成分的言論。
⚖️ 2. 民事誹謗:切勿在未經證實的情況下,公開散播損害他人聲譽的虛假資訊。
⚖️ 3. 刑事恐嚇與煽惑罪行:絕不容許任何涉及威脅人身安全、煽動暴力或仇恨的極端言詞。
⚖️ 4. 維護國家安全相關法例:國家安全法例一律適用於所有在港人士(包括外籍及非華裔人士)。任何涉嫌在網上發表或散播危害國家安全、煽動社會仇恨的言論,均屬嚴重刑事罪行。
【展現僱主風度 理性應對爭議】
風度與理性,是解決問題的最佳利器。本會呼籲廣大僱主保持克制,展現香港市民的高質素。面對網絡上的惡意挑釁或涉嫌違法言論,與其陷入無謂的口舌之爭,我們建議採取更具建設性且合法的應對方式:冷靜將相關言論截圖存證,並適時向社交平台、平等機會委員會或警方等執法機關舉報。 這不僅是保護自身的最佳做法,更是維護香港法治社會的核心體現。
本會將一如既往,密切監察外傭政策的發展,並堅定不移地透過合法、理性、務實的渠道,向特區政府及相關部門反映僱主的真實訴求,致力保障僱主合法權益。我們深信,只有推動政策的良性修訂,才能真正解決勞資之間的深層次矛盾。

🔈【Call for Rational Communication Between Employers and Foreign Domestic Helpers ⚖️ Legal Responsibilities for Online Speech】
Recently, the Coalition of Global Home Service Sustainable Development (hereinafter referred to as the "Organisation") has noted the increasingly heated discussions on various online platforms regarding foreign domestic helper (FDH) policies and labor relations. While we fully understand employers' expectations for policy refinement and appreciate the hard work of FDHs who leave their home countries to work in Hong Kong, we are deeply concerned that some online remarks have become extreme, escalating into mutual insults and personal attacks between supporters of both sides.
The employment of FDHs is a crucial pillar for the daily operations of countless Hong Kong families. It is understandable that occasional emotional friction may arise due to differences in living habits and expectations. However, the Organisation must issue a sincere reminder: while freedom of speech is a core value of Hong Kong, the exercise of this right must never override the law. The internet is not a lawless realm. For both employers and foreign domestic helpers, extreme remarks made under the guise of "human rights" or "freedom of speech" are 🚫not exempt from legal consequences and may lead to severe legal liabilities.
To protect the legitimate rights of both employers and FDHs, and to prevent individuals from inadvertently breaking the law due to emotional provocation, the Association hereby reiterates that anyone expressing opinions on online platforms must strictly abide by the current laws of Hong Kong and refrain from crossing the following legal boundaries🚫:
⚖️ 1. Race Discrimination Ordinance: Avoid making any remarks that involve racial vilification, harassment, or discrimination against any race, nationality, or background.
⚖️ 2. Civil Defamation: Do not publicly spread unverified, false information that damages the reputation of others (including employers or FDHs).
⚖️ 3. Criminal Intimidation and Incitement: Extreme language involving threats to personal safety, or the incitement of violence and hatred, is strictly prohibited.
⚖️ 4. National Security-related Laws: National security laws apply to all persons in Hong Kong (including local residents, expatriates, and non-ethnic Chinese). Anyone suspected of publishing or spreading remarks online that endanger national security or incite hatred among social classes is committing a serious criminal offence.
【Demonstrating Empathy and Responding Rationally】
Rationality and grace are the best tools for resolving conflicts. The Association calls on both employers and the FDH community to exercise restraint and mutual respect. When encountering malicious provocation or suspected illegal remarks online, rather than engaging in meaningless arguments, we recommend adopting a more constructive and lawful approach: calmly take screenshots of the relevant remarks for evidence, and report them to the social media platforms, the Equal Opportunities Commission (EOC), or law enforcement agencies such as the Police. This is not only the best way to protect oneself but also a core manifestation of upholding Hong Kong's rule of law.
The Organisation will, as always, closely monitor the development of FDH policies and remain committed to reflecting the genuine demands of the industry and families to the HKSAR Government and relevant departments through lawful, rational, and pragmatic channels. We firmly believe that only by building mutual trust between employers and employees and promoting positive policy amendments can we truly resolve deep-rooted conflicts and achieve a win-win situation.
Let us work together to safeguard a healthy, respectful, and law-abiding online environment and contribute to building a harmonious society.
