CRIMINAL CHARGE IS NOT COMPLAINT
Criminal Charge vs. Complaint Stop confusing them, they are not the same thing at all
Many people believe that once they report a matter to the police, the next step is court. They think a complaint automatically becomes a criminal case. It doesn’t work like that.
In law, a complaint and a criminal charge are two completely different things and understanding the difference will save you from disappointment, frustration, and unnecessary pressure on the police.
A complaint is simply you reporting a matter. It is you walking into the station or writing a petition to say: “This happened to me. I want the police to look into it.”
A complaint starts the conversation. It triggers investigation. It makes the police aware something may be wrong but a complaint is not a case. It is not an arrest warrant. It is not an automatic trip to court.
A criminal charge, on the other hand, is when the state officially takes the matter up and files it in court. This only happens after the police have done their investigation and confirmed that:
👉🏼 A real offence exists
👉🏼 There is evidence to support it
👉🏼 The evidence meets legal standards
👉🏼 The suspect can be connected to the crime. This is why “my complaint” and “my charge” are not the same.
You can report something and the police may discover:
👉🏼 It is a civil matter
👉🏼 There is no evidence
👉🏼 The facts don’t add up
👉🏼 The witnesses are unreliable
👉🏼 The elements of the offence are not complete. When that happens, the police cannot file a criminal charge because the law requires proof, not emotions.
Not every complaint becomes a charge. Not every report becomes a court case. Not every story has the evidence to stand as a criminal offence. A criminal charge only arises when the police gather enough evidence that can survive in court.
Not assumptions.
Not guesses.
Not accusations.
Actual evidence.
Understanding this helps you to:
✔ Avoid unnecessary pressure on the police
✔ Stop expecting court when there is no legal basis
✔ Know when a matter is civil, not criminal
✔ Appreciate why some petitions don’t become charges
✔ Follow the right channel for your issue
Law is structured.
Process matters.
Evidence determines everything.
So before you get angry that “the police didn’t charge the person,” ask one simple question: Is there evidence strong enough to meet legal standards? Because only then can a complaint transform into a criminal charge.
