New Generation Leaders - The Gambia is deeply concerned by the recent arrest and detention of our fellow young people, members of the Gambians Against Looted Assets (GALA), by the Gambia Police Force. This action is not only a direct violation of their fundamental rights to peaceful assembly and expression but also a grave affront to democratic principles enshrined in our Constitution.
The Constitution of The Gambia guarantees the right to peaceful assembly and freedom of expression for all citizens. Section 25(1)(d) of the Constitution provides that "every person shall have the right to assemble and demonstrate peacefully without arms." The Public Order Act, which governs public assemblies, further requires that any decision to deny a permit for a peaceful assembly must be justified and communicated transparently. Unfortunately, the denial letter issued by the police to GALA members did not provide any valid reason for the refusal of their permit. Moreover, the police failed to suggest an alternative date for the peaceful protest or engage in a constructive dialogue with the applicants.
Such actions by the police undermine public trust in law enforcement institutions and threaten the democratic fabric of our nation. The right to peaceful assembly is a cornerstone of democratic governance, and its denial without lawful justification is unacceptable.
As an organization committed to youth empowerment, transparency, and democratic values, we are observing, learning, and growing. The government we once hoped would uphold the mantra has failed us on that promise. The suppression of our rights only strengthens our resolve to stand for democracy, accountability, and transparency.
We, therefore, demand the following:
1. The immediate and unconditional release of all detained GALA members.
2. An official explanation from the Gambia Police Force for the denial of the permit without a valid reason.
3. A commitment from the government and law enforcement agencies to uphold the constitutional rights of all citizens, including the right to peaceful assembly and protest.
4. Immediate engagement between the Gambia Police Force and GALA representatives to ensure their concerns are addressed through lawful and peaceful means.
We stand in solidarity with our fellow young people and urge all Gambians to continue advocating for transparency, accountability, and respect for human rights in our beloved nation.
