European Network on Independent Living - ENIL
20 years after the adoption of the UN Convention on the Rights of Persons with Disabilities (UNCRPD), many disabled people across Europe are still denied the right to decide about their own lives.
Across Europe, disabled people are still placed under guardianship and other substitute decision-making systems that strip away legal capacity and control over our own lives. This makes independent living impossible and continues to violate fundamental rights.
On European Independent Living Day 2026, ENIL brought together self advocates, activists, organisations of persons with disabilities, legal experts and policymakers in Brussels to discuss legal capacity and supported decision-making.
Speakers highlighted that progress on legal capacity remains slow and inconsistent across Europe, while coercion, institutionalisation and stigma still prevent many disabled people from exercising choice and control over their own lives.
Speakers stressed that:
• legal capacity is a fundamental human right
• supported decision-making must replace guardianship systems
• laws alone are not enough - attitudes, services and support systems must also change
• without legal capacity, independent living is not possible
