Here's a useful Universal Credit hack: if your disabled child plans on staying in education, they should consider making a credits-only claim for 'new style' Employment and Support Allowance (ESA) when they turn 16.

They won't qualify for the benefit itself, but simply submitting a credits-only claim will force the DWP to carry out a work capability assessment to decide whether your child is unfit for work.

By establishing a limited capability for work early on, your child will later be able to claim Universal Credit in their own right if they end up staying in non-advanced education beyond their 19th birthday — or if they leave one course and then start another.

Due to a change in the law, most disabled students who haven't established a limited capability for work *before* starting a course can no longer qualify for Universal Credit.

That's why it is a good idea to trigger this assessment by making a credits-only claim for new-style ESA once they turn 16. If the DWP agrees that your child has a limited capability for work, that decision will also be binding on Universal Credit later on.

And because a credits-only claim won’t lead to any actual ESA being paid, it won't impact on Child Benefit, tax credits or any other benefits you get for your son or daughter as a dependent child.
