New legislation means tighter definitions, greater due diligence expectations, and real consequences for non-compliance. The days of cutting corners are numbered.

The umbrella consultation has landed.

Today, the government published 'Make Work Pay: Modernising the Agency Work Regulatory Framework' – a 63-page consultation that could reshape how the temporary labour market is regulated.

It covers four pillars: security, transparency, choice, and modernisation. The proposals include bringing umbrella companies within scope of the Conduct Regulations, restricting kickbacks, preventing workers from being forced into umbrella arrangements, and streamlining administrative burdens for compliant businesses.

The consultation closes on 1st May 2026.

FCSA will be developing a comprehensive response, drawing on the expertise of our Accredited Members, Recruiter Partners, Business Partners and our Industry Working Group.

We've been calling for fit-for-purpose regulation for years. Now we need to make sure the detail matches the ambition.
