INCCIP Webinar – Dealing with unmet justice needs: The Mexican families legal empowerment experience
UPDATE - The speakers for our webinar this Friday, 5th December, have been announced and are:

Edwin Pineda is a member of the colectiva “Pervivencias”, brother of a person deprived of Liberty. He was a participant of the “Escuela de abogacía y activismo para familiares de personas en prisión”, which took place from January to May of this year. He is interested in the human rights, justice and prison system. Edwin works in Censos Nacionales de Gobierno of INEGI.

Juan Morey is an experienced Argentine lawyer specializing in human rights and criminal enforcement law across Mexico and Latin America, combining institutional consulting with academic leadership in penal system reform. He provides specialized consultancy on torture prevention and criminal enforcement frameworks to key institutions including Mexico's Supreme Court, and currently serves as Legal Empowerment Coordinator at Documenta: Analysis and Action for Justice. Mr. Morey contributes his expertise to academia, serving as Academic Coordinator and Instructor in Criminal Enforcement Law across multiple courses and postgraduate programs. He has authored numerous technical protocols and publications with governmental institutions on Mexico's National Law on Criminal Enforcement, conditions of detention, and torture eradication, while actively contributing to international legal forums and restorative justice initiatives throughout Latin America.

On 18 June 2025, the Ministers of Justice of Estonia and Sweden formalised a prison lease agreement between the two countries. If both national parliaments ratify this agreement, the first group of foreign imprisoned people is expected to be transferred to Estonia in the second half of 2026. Reportedly, such imprisoned people are more likely to be of nationalities other than Swedish, but currently serving sentences in Sweden and typically expected to be adult males serving longer sentences.

Beyond the many challenges posed by the prison lease itself, the impact on the families of imprisoned people sent to Estonia—particularly their children—cannot be overlooked. A child’s parent or other close relative being transferred from Sweden to serve a prison sentence in Estonia can pose practical and emotional difficulties for the child and feel as if the person had been taken away entirely.

Advisers to the Estonian Chancellor of Justice have pointed out in their opinion that children’s rights and family connections must never be an afterthought. When implementing the bilateral agreement, it is crucial to account for how difficult and costly it may be to maintain contact with a family member serving a sentence in a foreign country. Both countries must carefully consider measures to facilitate such communication, including clear agreements on who will cover the associated costs—such as travel expenses for visiting a parent or close relative in an Estonian prison.

The Chancellor of Justice’s most recent inspection of Tallinn Prison highlighted serious challenges that the people currently serving sentences in Estonia already face: limited access to information, support and reintegration programmes due to language barriers, difficulties accessing healthcare and expensive international phone calls. Notably, video calls were not provided and contact with family members abroad was extremely limited.

These issues must be addressed now, and certainly before hundreds of imprisoned people arrive from Sweden. It is crucial that both countries carefully consider the broader impact on children and families left behind and ensure that meaningful contact is preserved.

In addition to the situation of Swedish prisoners and their families, the Chancellor of Justice has emphasised that the implementation of the prison lease agreement should not lead to a deterioration in the conditions of Estonia’s own prisoners. This may also include the potential decline in visits opportunities for their families: to free up one of Estonia’s three prisons for Swedish prisoners, local prisoners are being transferred to the other two facilities. Since these prisons now have higher populations but the same number of visiting rooms and visiting hours, it has already been reported that family visits have been affected.
