In quite a shocking development, the Cambourne to Cambridge Guided Busway Public Inquiry looks to be delayed (likely considerably) after the applicant, Cambridgeshire County Council, failed to comply with the mandatory requirement to post a public notice in the locality at least 2 weeks before the start of the inquiry. This is a requirement under Rule 13(6)(b) of the Transport and Works (Inquiries Procedure) Rules 2004.
Neil Cameron KC has submitted for Cambridgeshire County Council that the inspector has discretion not to accept the Secretary of State's advice to postpone the inquiry. The inspector, however, has indicated that he intends to follow the advice from the Secretary of State to adjourn the inquiry to allow Rule 13(6)(b) to be complied with.
The inquiry now stands adjourned for a planned site visit until 2 p.m. on Wednesday, September 17, and the inspector will presumably made a decision on a longer adjournment at that time after the county council has had an opportunity to make representations to the Transport Infrastructure Planning Unit.
It would seem, however, rather difficult for the county council to argue that its substantive noncompliance with Rule 13(6)(b) has not caused prejudice to those who would have seen the notice had it been posted. And, in any event, not adjourning for at least two weeks could well give rise to grounds for statutory review of the Secretary of State's final decision.
