What does RTA mean?

In the context of motor accidents, RTA stands for Road Traffic Accident.

Also referred to as a Road Traffic Collision or Crash (RTC), they are accidents that cause bodily injury or damage to property, as a result of use of a motor vehicle, including cars, trucks, motorbikes, bicycles, pedestrians and passengers.

When you are involved in a car crash, your solicitor will likely refer to your claim as an RTA or Personal Injury (PI) claim.

What is a 'no win no fee' agreement?

No Win No Fee, also known as a Conditional Fee Agreement (CFA) is a way of funding a claim.

When you are involved in a Personal Injury claim, you will incur certain costs (or fees) for receiving legal services from your solicitor.

Whoever pays these fees comes down to a number of things,
including the result of the case and the settlement amount.

A no win no fee agreement, is an agreement between you and your solicitor put into place at the start of your claim, whereby you agree that if you win your case you will pay the solicitor and he/she will be deducting a success fee from your settlement amount. On the other hand, if you do not win the case, then the solicitors will not charge you for the costs of their services.

When processing your road traffic accident claim, your solicitor may refer to the 'limitation period' of your case.

The Limitation Period means the amount of time following an accident that you have to file a claim form with the court in your case.

This period of time can change in some cases but, for most injury claims, the claim form must be filed within three years from the date of the accident.

This can sometimes be longer if the person filing the claim was in a coma following the accident. There is no primary limitation period if the person is unable to make decisions for themselves because of an injury or disability.

The closer you are to the limitation period deadline, the less likely a firm is to accept your case, as there are certain risks solicitors face when accepting a claim close to the expiry of the limitation period.

It's therefore important that you act quickly following a road traffic accident to ensure that you stand the best chance of gaining access to justice.

But all actions on the road have consequences and even vulnerable road users must be mindful of others to avoid causing an accident.
