دعا التحالف الدولي للدفاع عن الحقوق والحريات AIDL إلى تشكيل لجنة تحقيق دولية عاجلة لتقصي الحقائق بشأن المأساة الإنسانية المروعة التي شهدتها المنطقة الحدودية بمدينة سبتة يومي 30 و31 يوليو 2026.

وأشار التحالف إلى أنه تابع بقلق بالغ الأحداث التي شهدتها مدينة سبتة وما نجم عنها من تداعيات إنسانية خطيرة. ووفقًا للأرقام الرسمية المتداولة، لقي ما لا يقل عن 75 شخصًا حتفهم نتيجة الغرق أو التدافع أو السقوط في المناطق الصخرية، فيما تفيد معلومات أخرى بأن عدد الوفيات قد يتجاوز مائة شخص. كما احتاج أكثر من ألف شخص إلى الرعاية الطبية، بينما لا تزال الحصيلة النهائية للوفيات والمفقودين والمصابين بحاجة إلى تحقق مستقل ودقيق.

ووقعت هذه الأحداث المأساوية عقب الدخول الجماعي لعشرات الآلاف من الأشخاص إلى مدينة سبتة، في واحدة من أكبر موجات العبور الجماعي المسجلة نحو الأراضي الإسبانية.

وأعلنت السلطات الإسبانية لاحقًا أن نحو 48,300 شخص ممن دخلوا مدينة سبتة خلال أحداث يومي 30 و31 يوليو 2026 عادوا إلى المغرب، قبل أن تحدّث تقديراتها وتعلن أن نحو 69,500 شخص أُعيدوا خلال الأيام الأربعة التالية للأحداث، فيما بدأت الأوضاع في المدينة بالاستقرار تدريجيًا.

وفي المقابل، غابت السلطات المغربية عن المشهد العام خلال المرحلة الأولى من المأساة، من دون أن يقدم رئيس الحكومة أو وزير الداخلية توضيحات رسمية كاملة وشفافة وعلنية بشأن ملابسات ما جرى، أو مصارحة الشعب المغربي بالأسباب الحقيقية التي دفعت بالآلاف إلى ذلك الوضع المأساوي والخطوات اللازمة لمعالجتها.

وأصدرت وزارة الداخلية المغربية بيانًا مقتضبًا في وقت متأخر. وفي أول توضيح رسمي يقدمه مسؤول حكومي مغربي منذ بداية الأزمة، عزا المسؤول، في 3 أغسطس 2026، التدفق الجماعي إلى معلومات مضللة جرى تداولها عبر وسائل التواصل الاجتماعي، وإلى استغلال شبكات تهريب المهاجرين والاتجار بالبشر، مؤكدًا، وفق قوله، أنه لم يحدث من جانب السلطات أي تخفيف لإجراءات المراقبة الحدودية أو أي تقليص لوجود قوات الأمن.

ويرى التحالف أن ما جرى لا يمكن النظر إليه من زاوية أمنية فقط، أو باعتباره حادثًا حدوديًا معزولًا مرتبطًا بالهجرة غير النظامية أو بانتشار معلومات مضللة, فما حدث يكشف عن مشكلة اقتصادية وسياسية ومعيشية حقيقية، تستوجب أن تتحمل الحكومة المغربية، بجدية، مسؤوليتها الداخلية تجاه الشعب المغربي، من خلال التواصل المباشر مع المواطنين، ودراسة الأوضاع المعيشية والتداعيات المجتمعية، وفتح حوار جاد بين الحكومة والمواطنين، والإسراع في معالجة قضايا الناس ومعاناتهم التي دفعت بالآلاف إلى تعريض حياتهم للخطر بذلك الشكل المأساوي, وهوا ما يمنع تكرار أحداث مماثلة، بدلًا من تجاهل هذه القضايا أو عزلها عن سياقها الداخلي.

ويرى التحالف كذلك أن تكرار أحداث مماثلة بهذا الحجم يستوجب تشكيل لجنة تحقيق دولية بصورة عاجلة، تتولى التحقيق في الوقائع، والاستماع إلى الضحايا والشهود، وتقييم مدى امتثال جميع الأطراف لالتزاماتها القانونية، وإصدار تقرير علني يتضمن النتائج والتوصيات وتحديد المسؤوليات.

كما يتعين مكافحة شبكات تهريب المهاجرين والاتجار بالبشر، وإنشاء مسارات قانونية وآمنة تصون الكرامة الإنسانية وتحمي الحق في الحياة، بدلًا من مواصلة تشديد التدابير والتشريعات الحدودية، أو الاكتفاء بالتفسيرات السياسية أو الأمنية العامة التي لا توضح بصورة كاملة كيفية وقوع المأساة ولا تحدد المسؤولين عنها. وينبغي أن يشمل التحقيق تقييمًا كاملًا لتصرفات البلدين كليهما في إدارة الأزمة.

وذكّر التحالف بأنه، عقب أحداث سبتة عام 2021، أدان البرلمان الأوروبي استخدام مراقبة الحدود وتدفقات الهجرة، ولا سيما عبور الأطفال والقاصرين غير المصحوبين بذويهم، أداةً للضغط السياسي على إسبانيا. وأكد التحالف أن إشراك الأطفال والأسر في عمليات العبور الجماعي عرّض حياتهم وسلامتهم لمخاطر جسيمة.

وأكد التحالف أن إدارة الهجرة والأزمات المرتبطة بها لا يجوز أن تقوم على استغلال المعاناة الإنسانية لأغراض سياسية أو تعريض الأشخاص لمخاطر تهدد حياتهم, كما لا يجوز استخدام مراقبة الحدود أو تدفقات الهجرة أدواتٍ للضغط أو للتأثير السياسي.

وأشار إلى أن سياسات الهجرة يجب أن تستند إلى احترام حقوق الإنسان، ومعالجة الأسباب الحقيقية والجذرية الدافعة إلى الهجرة والمرتبطة بالفقر والتهميش وعدم المساواة وانعدام الفرص، وأن تهدف إلى تحقيق العدالة.

ويرفض التحالف كذلك تصوير المهاجرين واللاجئين باعتبارهم غزوًا أو تهديدًا أمنيًا جماعيًا، أو استخدام أي خطاب يحرض على الكراهية أو العنصرية. ويتعارض ذلك مع مبادئ حقوق الإنسان والكرامة الإنسانية، ويسهم في تأجيج التمييز والعنف والكراهية، ويقوض الاستجابة الإنسانية التي تقتضيها هذه الأزمة.

وأكد التحالف أن الشبكات الإجرامية المتورطة في تهريب المهاجرين والاتجار بالبشر تستغل هشاشة الضحايا، وتنشر معلومات مضللة، وتنظم تحركات تعرض الأشخاص لخطر الغرق والإصابة والوفاة.

وطالب التحالف بضرورة تحديد العدد الحقيقي للوفيات والمفقودين والمصابين، والتعرّف إلى هويات الضحايا، وإبلاغ أسرهم، والالتزام بتسليم جثامين المتوفين إليها، وضمان حصول هذه الأسر على معلومات دقيقة بشأن مصير ذويها.

كما دعا السلطات الإسبانية والمغربية إلى مواصلة عمليات البحث والإنقاذ، وتوفير الرعاية الطبية اللازمة للمصابين، والكشف العاجل عن مصير المفقودين.

ويؤكد التحالف أن سيادة الدول على حدودها لا تعفيها من التزاماتها القانونية بحماية الحق في الحياة، واحترام الكرامة الإنسانية، وضمان معاملة جميع الأشخاص معاملة إنسانية، وفقًا للقانون الدولي لحقوق الإنسان.

ودعا إلى إخضاع جميع أعمال قوات الأمن المغربية والإسبانية والسلطات المكلفة بإنفاذ القانون خلال إدارة هذه الأزمة لرقابة مستقلة وفعالة. كما طالب بإجراء تحقيقات فورية ونزيهة في أي ادعاءات تتعلق بالاستخدام المفرط أو غير المشروع للقوة.

والذي من المقرر أن يناقش البرلمان الأوروبي الخميس الأوضاع المرتبطة بالحادثة.

واختتم التحالف الدولي AIDL بيانه بالتأكيد على أنه سيواصل متابعة تطورات الأحداث، والتحقق من الوقائع المرتبطة بها، واتخاذ جميع الإجراءات القانونية والحقوقية اللازمة لدعم الجهود الرامية إلى تحديد المسؤوليات، وتحقيق العدالة، وضمان عدم الإفلات من المساءلة.

Alliance Internationale AIDL Calls for an Urgent International Commission of Inquiry into the Humanitarian Tragedy in Ceuta

The Alliance Internationale pour la Défense des Droits et des Libertés (AIDL) called for the urgent establishment of an international commission of inquiry to establish the facts surrounding the devastating humanitarian tragedy that occurred in the border area of Ceuta on 30 and 31 July 2026.

AIDL stated that it had followed with profound concern the events in Ceuta and their grave humanitarian consequences. According to official figures circulated, at least 75 people lost their lives as a result of drowning, crowd crushes or falls in rocky areas, while other reports indicate that the death toll may exceed one hundred. More than one thousand people required medical care, while the final numbers of those killed, missing and injured still require independent and rigorous verification.

These tragic events followed the mass entry of tens of thousands of people into Ceuta, in one of the largest mass crossings recorded into Spanish territory.

The Spanish authorities subsequently announced that approximately 48,300 people who had entered Ceuta during the events of 30 and 31 July 2026 had returned to Morocco. They later updated their estimates and reported that approximately 69,500 people had been returned during the four days following the events, as the situation in the city gradually began to stabilise.

By contrast, the Moroccan authorities remained absent from public view during the initial phase of the tragedy. Neither the Head of Government nor the Minister of the Interior provided complete, transparent and public explanations regarding the circumstances of what occurred, nor did they openly inform the Moroccan people of the underlying causes that drove thousands into such a tragic situation and the measures required to address them.

The Moroccan Ministry of the Interior issued a brief statement at a late stage. In the first official explanation provided by a Moroccan government official since the crisis began, the official attributed the mass movement on 3 August 2026 to misleading information circulated through social media and to the activities of networks engaged in migrant smuggling and human trafficking. The official further stated that the authorities had neither relaxed border-control measures nor reduced the presence of security forces.

AIDL considers that these events cannot be viewed solely from a security perspective or presented as an isolated border incident linked exclusively to irregular migration or the spread of misleading information. What occurred reveals a genuine economic, political and social crisis that requires the Moroccan Government to assume its domestic responsibility towards the Moroccan people by engaging directly with citizens, examining living conditions and their social consequences, opening a serious dialogue between the Government and the public, and urgently addressing the problems and hardships that drove thousands of people to place their lives at risk in such tragic circumstances. Such action would help prevent similar events from recurring, instead of ignoring these issues or separating them from their domestic context.

AIDL further considers that the recurrence of events of this magnitude requires the urgent establishment of an international commission of inquiry mandated to investigate the facts, hear victims and witnesses, assess all parties’ compliance with their legal obligations, and publish a report containing its findings, recommendations and determination of responsibility.

It is also necessary to combat networks engaged in migrant smuggling and human trafficking and to establish safe and legal pathways that preserve human dignity and protect the right to life, instead of continuing to tighten border measures and legislation or relying on general political or security explanations that neither fully clarify how the tragedy occurred nor identify those responsible. The investigation should also include a comprehensive assessment of the conduct of both countries in their handling of the crisis.

AIDL recalled that, following the events in Ceuta in 2021, the European Parliament condemned the use of border controls and migration flows, particularly the crossing of children and unaccompanied minors, as an instrument of political pressure against Spain. AIDL stressed that involving children and families in mass crossings exposed their lives and safety to serious risks.

AIDL affirmed that the management of migration and related crises must not be based on exploiting human suffering for political purposes or exposing people to life-threatening risks. Border controls and migration flows must not be used as instruments of pressure against States or as tools of political influence.

AIDL stated that migration policies must be grounded in respect for human rights, address the genuine and structural causes driving migration, including poverty, marginalisation, inequality and lack of opportunities, and advance justice.

AIDL also rejects any characterisation of migrants and refugees as an invasion or a collective security threat, as well as any rhetoric that incites hatred or racism. Such narratives are incompatible with the principles of human rights and human dignity, contribute to escalating discrimination, violence and hatred, and undermine the humanitarian response required by this crisis.

AIDL affirmed that criminal networks involved in migrant smuggling and human trafficking exploit the vulnerability of victims, spread misleading information and organise movements that expose people to the risk of drowning, injury and death.

AIDL called for the true number of those killed, missing and injured to be established, for the victims to be identified, for their families to be informed, for the remains of those who died to be returned to their families, and for those families to receive accurate information concerning the fate of their loved ones.

AIDL also called on the Spanish and Moroccan authorities to continue search-and-rescue operations, provide the necessary medical care to those injured, and urgently clarify the fate of missing persons.

AIDL emphasises that State sovereignty over national borders does not exempt States from their legal obligations to protect the right to life, respect human dignity and ensure that all persons are treated humanely in accordance with international human rights law.

AIDL called for all actions undertaken by Moroccan and Spanish security forces, as well as by law-enforcement authorities during the management of this crisis, to be subjected to independent and effective oversight. It also called for immediate and impartial investigations into any allegations concerning the excessive or unlawful use of force.

The International Alliance for Rights and Freedoms (AIDL) concluded its statement by affirming that it would continue to monitor developments, verify the facts related to the events, and take all necessary legal and human rights measures to support efforts aimed at establishing responsibility, securing justice and preventing impunity.

La Alianza Internacional AIDL pide la creación urgente de una comisión internacional de investigación sobre la tragedia humanitaria de Ceuta

La Alianza Internacional para la Defensa de los Derechos y las Libertades (AIDL) pidió la creación urgente de una comisión internacional de investigación para esclarecer los hechos relacionados con la trágica crisis humanitaria registrada en la zona fronteriza de Ceuta los días 30 y 31 de julio de 2026.

La Alianza señaló que ha seguido con profunda preocupación los acontecimientos registrados en Ceuta y sus graves consecuencias humanitarias. Según las cifras oficiales difundidas, al menos 75 personas perdieron la vida a consecuencia de ahogamientos, avalanchas humanas o caídas en zonas rocosas, mientras que otras informaciones indican que el número de fallecidos podría superar el centenar. Más de mil personas necesitaron atención médica, y las cifras definitivas de fallecidos, desaparecidos y heridos aún requieren una verificación independiente y rigurosa.

Estos trágicos acontecimientos se produjeron tras la entrada colectiva de decenas de miles de personas en Ceuta, en una de las mayores oleadas de cruces masivos registradas hacia territorio español.

Las autoridades españolas anunciaron posteriormente que alrededor de 48.300 personas que habían entrado en Ceuta durante los acontecimientos de los días 30 y 31 de julio de 2026 regresaron a Marruecos. Más tarde, actualizaron sus estimaciones e informaron de que aproximadamente 69.500 personas habían sido devueltas durante los cuatro días posteriores a los hechos, mientras la situación en la ciudad comenzaba a estabilizarse progresivamente.

En contraste, las autoridades marroquíes permanecieron ausentes de la escena pública durante la primera fase de la tragedia, sin que el jefe del Gobierno ni el ministro del Interior ofrecieran explicaciones oficiales completas, transparentes y públicas sobre las circunstancias de lo ocurrido, ni comunicaran con franqueza al pueblo marroquí las causas reales que empujaron a miles de personas a aquella situación trágica y las medidas necesarias para abordarlas.

El Ministerio del Interior marroquí emitió tardíamente un breve comunicado. En la primera explicación oficial ofrecida por un responsable gubernamental marroquí desde el inicio de la crisis, el 3 de agosto de 2026, el responsable atribuyó el flujo masivo a la difusión de información engañosa a través de las redes sociales y a la actuación de redes dedicadas al tráfico ilícito de migrantes y la trata de personas. Asimismo, afirmó que las autoridades no habían flexibilizado las medidas de vigilancia fronteriza ni reducido la presencia de las fuerzas de seguridad.

La Alianza considera que lo ocurrido no puede analizarse únicamente desde una perspectiva de seguridad ni presentarse como un incidente fronterizo aislado, relacionado exclusivamente con la migración irregular o con la difusión de información engañosa. Los acontecimientos revelan un problema real de naturaleza económica, política y social que exige que el Gobierno marroquí asuma seriamente su responsabilidad interna ante el pueblo marroquí mediante el contacto directo con la ciudadanía, el análisis de las condiciones de vida y sus repercusiones sociales, la apertura de un diálogo serio entre el Gobierno y la población, y la adopción urgente de medidas para abordar los problemas y padecimientos que empujaron a miles de personas a poner sus vidas en peligro de forma tan trágica. Ello contribuiría a evitar la repetición de acontecimientos similares, en lugar de ignorar estas cuestiones o desvincularlas de su contexto interno.

La Alianza considera asimismo que la repetición de acontecimientos de esta magnitud exige la creación urgente de una comisión internacional de investigación encargada de esclarecer los hechos, escuchar a las víctimas y los testigos, evaluar el grado de cumplimiento de las obligaciones jurídicas por todas las partes y publicar un informe que incluya sus conclusiones, recomendaciones y la determinación de responsabilidades. También resulta necesario combatir las redes dedicadas al tráfico ilícito de migrantes y la trata de personas, y establecer vías legales y seguras que preserven la dignidad humana y protejan el derecho a la vida, en lugar de continuar endureciendo las medidas y la legislación fronterizas o limitarse a explicaciones generales de carácter político o de seguridad que no aclaran plenamente cómo ocurrió la tragedia ni identifican a sus responsables. La investigación también deberá incluir una evaluación completa de la actuación de ambos países en la gestión de la crisis.

La Alianza recordó que, tras los acontecimientos ocurridos en Ceuta en 2021, el Parlamento Europeo condenó la utilización del control fronterizo y de los flujos migratorios, especialmente el cruce de niños y menores no acompañados, como instrumento de presión política sobre España. La Alianza subrayó que la participación de niños y familias en los cruces masivos expuso sus vidas y su integridad a graves riesgos.

La Alianza afirmó que la gestión de la migración y de las crisis relacionadas con ella no puede basarse en la explotación del sufrimiento humano con fines políticos ni en la exposición de las personas a riesgos que amenacen sus vidas. Tampoco se pueden utilizar el control fronterizo o los flujos migratorios como instrumentos de presión sobre los Estados o de influencia política.

La Alianza señaló que las políticas migratorias deben fundamentarse en el respeto de los derechos humanos, abordar las causas reales y estructurales que impulsan la migración, vinculadas con la pobreza, la marginación, la desigualdad y la falta de oportunidades, y promover la justicia.

La Alianza rechaza asimismo cualquier caracterización de los migrantes y refugiados como una invasión o una amenaza colectiva para la seguridad, así como cualquier discurso que incite al odio o al racismo. Tales planteamientos contradicen los principios de los derechos humanos y la dignidad humana, contribuyen a intensificar la discriminación, la violencia y el odio, y debilitan la respuesta humanitaria que esta crisis exige.

La Alianza afirmó que las redes delictivas implicadas en el tráfico ilícito de migrantes y la trata de personas explotan la vulnerabilidad de las víctimas, difunden información engañosa y organizan desplazamientos que exponen a las personas al riesgo de ahogamiento, lesiones y muerte.

La Alianza reclamó que se determine el número real de fallecidos, desaparecidos y heridos, se identifique a las víctimas, se informe a sus familias, se garantice la entrega de los restos mortales de las personas fallecidas y se proporcione a sus familiares información precisa sobre el destino de sus seres queridos.

También pidió a las autoridades españolas y marroquíes que continúen las operaciones de búsqueda y rescate, proporcionen la atención médica necesaria a las personas heridas y esclarezcan urgentemente el destino de las personas desaparecidas.

La Alianza subraya que la soberanía de los Estados sobre sus fronteras no los exime de sus obligaciones jurídicas de proteger el derecho a la vida, respetar la dignidad humana y garantizar un trato humano a todas las personas, de conformidad con el derecho internacional de los derechos humanos.

La Alianza pidió que todas las actuaciones de las fuerzas de seguridad marroquíes y españolas, así como de las autoridades encargadas de hacer cumplir la ley durante la gestión de esta crisis, sean sometidas a una supervisión independiente y efectiva. También reclamó investigaciones inmediatas e imparciales sobre cualquier denuncia relativa al uso excesivo o ilícito de la fuerza.

La Alianza Internacional AIDL concluyó su declaración afirmando que continuará siguiendo la evolución de los acontecimientos, verificando los hechos relacionados con ellos y adoptando todas las medidas jurídicas y de defensa de los derechos humanos necesarias para apoyar los esfuerzos dirigidos a determinar responsabilidades, garantizar justicia e impedir la impunidad.

L'AIDL salue la publication des questionnaires des candidats à l'élection des juges de la Cour pénale internationale de 2026

L'Alliance Internationale (AIDL) se félicite de la publication, par l'Association du Barreau près la Cour pénale internationale (ICCBA), des questionnaires et des réponses écrites des candidats présélectionnés à l'élection des juges de la Cour pénale internationale de 2026.

L'AIDL, en sa qualité d'organisation accréditée auprès de l'Assemblée des États Parties au Statut de Rome de la Cour pénale internationale, considère que cette initiative renforce la transparence et l'intégrité du processus électoral, tout en permettant aux États Parties et à la communauté juridique internationale d'évaluer les candidats sur la base de leur compétence, de leur indépendance, de leur intégrité et de leur expérience judiciaire.

Combating Marginalization and Reducing Inequalities:
A Foundation for Justice, Peace, and Sustainable Development

AIDL International Foundation and the International Alliance for Rights and Freedoms (AIDL) affirm that marginalization and inequality are not merely development challenges. They constitute a direct threat to human dignity, social justice, stability, and peaceful societies, while undermining sustainable development and deepening poverty, exclusion, and social disparities.

At a time of escalating armed conflicts, economic crises, climate change impacts, and widening gaps in access to education, healthcare, decent work, and essential services, the most vulnerable and marginalized communities continue to bear a disproportionate burden, depriving millions of people of equal opportunities and the full enjoyment of their human rights and fundamental freedoms.

AIDL emphasizes that reducing inequalities requires inclusive and equitable public policies, stronger social protection systems, equal opportunities for all, and decisive action to eliminate all forms of discrimination, marginalization, and social exclusion. Empowering vulnerable groups is essential to achieving Sustainable Development Goal 10 and fulfilling international human rights commitments.
