የፌደራል ጠቅላይ ፍርድ ቤት ሰበር ሰሚ ችሎት በሰ/መ/ቁ.213607 ጥር 23 ቀን 2014 ዓ/ም የፕሮቪደንት ክፍያ ያለው ሠራተኛ የሥራ ስንብት ሊከፈለው እንደማይገባ አስገዳጅ ትርጉም ሰጥቷል። ምንም እንኳን ለሰበር ሰሚ ችሎቱ ትርጉም መነሻ የሆነው በአሠሪና ሠራተኛ አዋጅ ቁጥር377/1996 (በአዋጅ ቁጥር 494/1998 እንደተሻሻለ) አንቀጽ 39(1)(ሰ) እና (ሸ) ስለፕሮቪደንት ክፍያ በሕጉ የተቀመጠውን ሀረግ ቢሆንም ትርጉሙ ከክፍያዎቹ ዓላማ አንጻርም የተሰጠ ነው።

በአሠሪና ሠራተኛ አዋጅ ቁጥር 1156/2011 አንቀጽ 39(1) ላይ የተመለከተው የጡረታ አበል ለመቀበል ብቁ ያልሆነ የሚለው መስፈርት የሚያሳየውም የጡረታ አበል ተጠቃሚ ከሆነ ሠራተኛው ከአምስት ዓመት በላይ ቢያገልግልም የሥራ ስንብት ክፍያ ሊከፈለው እንደማይገባ የሚያስገነዝብ ነው። ይሕም ሕጉ ጡረታ አበል ያለው ሰው የሥራ ስንብት ክፍያ ሊያሳካው የሚፈልገውን ዓላማ ስለሚተካ ድጋሜ ክፍያው ሊፈጸም እንደማይገባ አቋም መወሰዱን ያሳያል። የጡረታ አበልና የፕሮቪደንት ክፍያ ደግሞ ተመሳሳይ ማሕበራዊ ዓላማ ያላቸው የክፍያ ዓይነቶች ናቸው። ስለሆነም ሰበር ሰሚ ችሎቱ ስለስራ ስንብት ክፍያና ፕሮቪደንት ክፍያ ዓላማን መሠረት አድርጎ የሠጠው ትርጉም አዲሱ የአሠሪና ሠራተኛ አዋጅ ቁጥር 1156/2011 አንቀጽ 39(1) የከፍያውን ዓላማ መሠረት አድርጎ የተቀረጸ በመሆኑ አዋጅ ቁጥር 1156/2011 አንቀጽ አተገባበር ላይም የሠበር ሰሚ ችሎቱ ትርጉም ተፈጻሚነት አለው።
