🚨 CONVOCATORIA DE HUELGA EN TRANSPERFECT 🚨

El sindicato FIST convoca a toda la plantilla de TRANSPERFECT TRANSLATIONS SL en España a secundar la huelga ✊

Denunciamos el uso fraudulento de los contratos fijos discontinuos:
• Se utilizan como si fueran contratos temporales
• Los periodos de actividad/inactividad son arbitrarios
• Se emplean como despidos encubiertos
• Se imponen cambios en condiciones laborales para reincorporarse

EXIGIMOS:
• Conversión de todos los contratos fijos discontinuos en indefinidos
• Fin de nuevas contrataciones bajo esta modalidad
• Pago de salarios por los periodos de inactividad

We denounce the fraudulent use of permanent-discontinuous contracts:
• Used as if they were temporary contracts
• Activity/inactivity periods are arbitrary
• Used as disguised dismissals
• Workers are forced to accept worse conditions to return

WE DEMAND:
• Conversion of all permanent-discontinuous contracts into permanent contracts
• An end to new hires under this contract type
• Payment of wages for inactivity periods

The High Court of Justice of Catalonia has dismissed TransPerfect’s appeal and CONFIRMED THE RULING FOR WAGE DISCRIMINATION.

The Court recognizes a violation of the fundamental right to equality and non-discrimination on the grounds of language, as the company failed to objectively justify the pay differences.

The ruling confirms for the claimants:
✔️ Pay equalization
✔️ Payment of compensation
✔️ Payment of outstanding wages previously unpaid

We are awaiting a possible appeal in cassation by the company, which cannot be admitted by the Supreme Court due to the absence of a conflicting judgment, as already established in the Webhelp/Concentrix case.

📢 IMPORTANT: TOMORROW’S DEMONSTRATION (26th Feb) IS CALLED OFF
The pressure on the Labour Inspectorate has paid off, and the main objective has been achieved: the procedure has been activated and prioritized urgently.

If in the coming weeks there is no real progress or an effective resolution, we will resume mobilizations, including rallies outside TransPerfect if necessary.

FIST would like to inform the workforce about the demonstration called for this Thursday, 26th February 2026, at 10 a.m. at the Labour Inspectorate (Travessera de Gràcia 303-311), to denounce its inaction regarding the complaints filed over the systematic and fraudulent use of the permanent seasonal (fixed-discontinuous) contract within the company.

FIST will continue the mobilizations through monthly demonstrations until there is a clear response from either the Labour Inspectorate or the company, calling partial strike hours so that the entire workforce can participate with legal coverage.

These days we are finalizing the organization: we have sent a press release to the main media outlets and convened an extraordinary assembly of the FIST union section.

FIST filed a collective labor dispute lawsuit seeking to annul the increase in targets imposed by the company, as productivity was increased without information, consultation, or negotiation, in violation of Art. 41 and 64 of the Workers’ Statute.

On December 5, the mandatory mediation took place, during which FIST proposed negotiating 3 commitments: replacing mandatory requirements with agreed incentive schemes, no sanctions or dismissals for failing to meet productivity targets, and ensuring prior information and a hearing for the committee and the union section in the event of productive changes. The company rejected all proposals, conditioning any negotiation on the withdrawal of all pending lawsuits, which was unacceptable.

FIST offered to commit to a temporary peace, which was also rejected. Arbitration and the intervention of the Technical Commission on Work Organization were proposed; FIST rejected arbitration but accepted the Commission’s involvement. Due to the company’s lack of response, no agreement was reached and the judicial proceedings continue.

FIST va presentar una demanda de conflicte col·lectiu per anul·lar l’augment d’objectius imposat per l’empresa, ja que es va incrementar la productivitat sense informació, consulta ni negociació, vulnerant els art. 41 i 64 de l’Estatut dels Treballadors.

El 5 de desembre es va celebrar la mediació obligatòria, en la qual FIST va proposar negociar 3 compromisos: substituir l’exigència obligatòria per un sistema d’incentius pactat, garantir la no sanció ni acomiadament per no assolir els objectius i assegurar informació prèvia i audiència al comitè i a la secció sindical davant qualsevol canvi productiu. L’empresa va rebutjar totes les propostes condicionant la negociació a la retirada de totes les demandes vigents, fet inacceptable.

FIST va oferir un compromís de pau temporal que també va ser rebutjat. En la mediació es va proposar l’arbitratge i la intervenció de la Comissió Tècnica d’Organització del Treball; FIST va rebutjar l’arbitratge però va acceptar la participació de la Comissió. Davant la manca de resposta de l’empresa, no es va arribar a cap acord i el procediment judicial continua.

FIST has filed a collective labor dispute lawsuit against the company to annul the productivity clause imposed on language data annotators, which we consider abusive and unlawful.

This clause requires at least a 75% score in internal evaluations and sets annual minimum targets, with failure treated as contractual misconduct. These disproportionate demands, based on arbitrary and non-transparent criteria, are being used to justify dismissals, contract pauses, and non-renewals, undermining job stability.

For these reasons, FIST demands the full nullification of these clauses for violating workers’ dignity and labor rights.

The conciliation meeting held on October 15 ended without agreement. The company denied that internal evaluations lead to dismissals or contract pauses and claimed adequate support is provided. FIST rejects this position and confirms that the dispute will proceed to court.

Des de FIST hem presentat una demanda de conflicte col·lectiu contra l'empresa per anul·lar la clàusula de productivitat imposada a les i els language data annotators, en considerar-la abusiva i contrària a la legalitat.

Aquesta clàusula exigeix com a mínim un 75% en les avaluacions internes i fixa objectius mínims anuals l’incompliment dels quals es considera falta contractual. Són exigències desproporcionades, amb criteris arbitraris i poc transparents, utilitzats per justificar acomiadaments, pauses de contracte i no renovacions, vulnerant l'estabilitat laboral.

Per tot això, des de FIST exigim la nul·litat total d’aquestes clàusules per vulnerar la dignitat i els drets laborals de les persones treballadores.

L’acte de conciliació del 15 d’octubre va acabar sense acord. L’empresa va negar l’impacte de les avaluacions en els acomiadaments o pauses de contracte i va afirmar que dona suport suficient a la plantilla. Des de FIST rebutgem aquesta versió i el conflicte seguirà la via judicial.
