The Czech Republic lacks an academic center whose goal would be to conduct an impartial research on human-rights-related topics. Despite of the fact that the Czech Republic often presents itself as a country which values human rights and tries to incorporate them also into its foreign policy, social science research on this topic is not well developed here. The Czech Center for Human Rights and De

mocracy (CCHRD) distinguishes itself from both other non-governmental institutions and governmental bodies dealing with this area. The Center represents an independent, academic institution, which is dedicated to analyze human rights from both social science and international law points of view. The existence of such center is very common in most European Union states; in some of these countries there are even more such centers operating. The Czech Center for Human Rights and Democracy has been founded to fill this gap and create an independent academic environment for human rights research. The Center cooperates with academic institutions. Both Faculty of Social Studies and Faculty of Law of the Masaryk University are to be found among partner institutions of the Center. It also cooperates with non-government institutions and judicial institutions - The Constitutional Court of the Czech Republic, The Supreme Administrative Court of the Czech Republic, or The European Court for Human Rights.

What can you find out there? 🤔

✅ Searching for proportionality was the red thread of the major events that occurred in the Czech law in the “pandemic year” 2021. It is apposite that the Czech Charter of Fundamental Rights and Freedoms celebrated its 30th anniversary as highlighted by Tereza Kuklová in her opening essay.

✅ Tereza further examines a parliamentary (in)competence to stop the government from declaring a state of emergency due to the Covid-19 pandemic and debates the major shortcomings of anti-pandemic measures. To get a glimpse at some particular violations, Nikola Sedláková examines the Constitutional Court's judgment concerning a general ban on retail sales. Daniela Matyášová then probes into the decision of the Supreme Administrative Court which annulled the mandate to wear a respirator.

✅ The next part of our review could be described by the notion of “security.” First, Tereza Kuklová introduces a controversial constitutional amendment regarding a right to defend one’s life with the use of a weapon. Nikola Sedláková examines various issues of national security emerging from the annual report of the Security Information Service. Daniela Matyášová then moves to discuss whether a recognition of same-sex adoption may be viewed as a threat to the Czech sovereignty. Lastly, Kateřina Ochodková discusses the constitutional procedure of removing presidential powers relating to the unfavourable health condition of the Czech President.

✅ Regarding the security of a person, Jana Koblasová examines the right to be provided with a placenta after childbirth and Nikola Sedláková sheds light on the judgment of the European Court of Human Rights concerning mandatory child vaccination.

✅ Our review concludes with remarks written by Kateřina Ochodková regarding an interesting effect of the new electoral system on elections to the (Czech) Chamber of Deputies in October 2021.

The Supreme Court of the United States has recently overturned the decades-old Roe v. Wade judgment protecting the right to abortion on a federal level. While some are celebrating the salvation of the lives of unborn babies, others are mourning the lives yet to be lost. The lives of pregnant people from various backgrounds who might die as a result of unwanted pregnancy or an illegal unsafe abortion. 🤰🫄

The head of the IIR Center for International Law, Professor Veronika Bílková, participated in the preparation of a Report on Violations of International Humanitarian and Human Rights Law, War Crimes and Crimes Against Humanity Committed in Ukraine as part of the expert mission of the OSCE Moscow Mechanism’s mission. 🧐🇺🇦

The report builds on previous findings and confirms that some violations of international law fulfill the characteristics of crimes against humanity and war crimes. Therefore, in addition to the responsibility of the state, the criminal responsibility of specific offenders also arises for them. ⚖️

Veronika Bílková spent 5 days in Ukraine as part of the mission. According to her findings, Russian Federation appears to delegate some controversial actions to the self-proclaimed Donetsk and Luhansk People's Republics (e.g. handing them detainees for the purpose of criminal proceedings, which may result in the imposition of the death penalty).

Vedoucí Centra mezinárodního práva Veronika Bílková se v rámci expertní mise Moskevského mechanismu OSCE – The Organization for Security and Co-operation in Europe podílela na vyhotovení zprávy o porušování mezinárodního humanitárního práva, mezinárodních lidských práv a o zločinech proti lidskosti na Ukrajině.

Zpráva navazuje na předchozí zjištění a potvrzuje, že některá porušení mezinárodního práva naplňují znaky zločinů proti lidskosti a válečných zločinů. Vzniká tedy za ně vedle odpovědnosti státu i trestní odpovědnost konkrétních pachatelů.

Veronika Bílková strávila v rámci mise 5 dní na Ukrajině. Podle jejích zjištění Rusko zřejmě deleguje některé kontroverzní kroky na samozvané lidové republiky Doněck a Luhansk (např. jim předává zadržené za účelem trestního řízení, které může vyústit v uložení trestu smrti).
