L’ONAC, désigne l’Ordre National des Architectes du Cameroun, il est institué par la loi n° 75/12 du 8 décembre 1975, comprend obligatoirement tous les architectes exerçant au Cameroun.
L’ordre veille au maintien des principes de moralité et de dévouement indispensables à l’exercice de la profession d’architecte ainsi qu’au respect des règles édictées par le code de déontologie.
L’ONAC exerce également toute attribution qui peut lui être confiée par la présente loi ou par des textes particuliers car il est doté de la personnalité morale, et son siège est fixé à Yaoundé. Il est placé sous la tutelle du ministère chargé de l’architecture.
L’ONAC est constitué de plusieurs sections qui régularisent son fonctionnement. On retrouve entre autre l’Assemblée Générale et le Conseil de l’Ordre:
LES CONDITIONS D’EXERCICE
L’exercice de la profession d’architecte au Cameroun est règlementé par LOI N° 90/041 D’AOUT 1990 et les conditions pour le faire sont les suivantes :
Nul ne peut exercer la profession d’architecte s’il n’est inscrit au tableau de l’ONAC.
Toutefois, peut exercer la profession d’architecte au Cameroun, un expatrié N’ayant pas été radié de l’Ordre des architectes de son pays d’origine ou de tout autre pays où il aurait exercé auparavant ; Etant recruté sur contrat ou en vertu d’un accord de coopération pour le compte exclusif de l’administration ; Servant pour le compte d’un cabinet d’architecte agréé
L’architecte en service dans l’administration ou exerçant en clientèle privée est soumis ;
Au secret professionnel au code des devoirs professionnels de l’architecte fixé par voie réglementaire ; aux dispositions statutaires de l’Ordre national des architectes.
L’EXERCICE ILLEGAL
Exerce illégalement la profession d’architecte, toute personne qui pratique sa profession en infraction aux dispositions de la présente loi, notamment : En travaillant sous un pseudonyme ; En offrant de l’aide à toute personne non habilitée à exercer ; En exerçant sans une police d’assurance en cours de validité.
Toute personne reconnue coupable d’exercice illégal de la profession d’architecte est passible d’un emprisonnement de six jours à six mois et d’une amende de deux cent mille Frs à deux millions Frs ou de l’une de ces deux peines seulement.
Le tribunal peut prononcer la confiscation du matériel ayant servi à la commission de l’infraction et la fermeture du cabinet.
Toute personne reconnue coupable d’infraction à la présente loi cesse immédiatement son activité.
En outre, la fermeture de son établissement est ordonnée par le Conseil de l’Ordre, indépendamment de toute décision judiciaire.
Le Conseil de l’Ordre national des architectes peut saisir la juridiction d’instruction ou la juridiction de jugement ou, le cas échéant, se constituer partie civile dans toute poursuite intentée par le ministère public contre toute personne inculpée ou prévenue d’exercice illégal de la profession d’architecte.
PRESENTATION OF NATIONAL ORDER OF CAMEROONIAN ARCHITECTS
The NOCA, designates the national order of Cameroonian architects; it is instituted by the law n°75/12 of 8th December, 1975 obligatory includes all the architects practicing in Cameroon. This order ensures the bearing of the principles of morality and essential dedication to the exercise of the profession of architect as well as the respect of rules enacted by the code of ethics.
NOCA also performs assignments that may be entrusted to him by the present law or by particular texts because it has the legal personality and its seat is in Yaounde. It is under the supervision of the Ministry of Housing and Urbanism.
NOCA has many branches that regulate its functions. We find among others the general assembly of the council of order.
CONDITIONAL EXERSICE
The exercise of the profession of architect in Cameroon is regulated by LAW N° 90/041 of AUGUST 1990 and the conditions to exercise are as follow:
A person can’t exercise the profession if he is not registered on the NOCA board.
An expatriate who has not been remove from the order of architects in his country or any other country where he has previously exercised can exercise in Cameroon; being recruited under contract or under a cooperation agreement and behalf on the administration alone; serving on behalf of a chartered architectural firm. The architect serving in the administration or exercising with private clients is subject: to a professional secrecy to the code of professional duties of the architects fixed by regulation; to the statutory provisions of the national order of architects.
ILLEGAL EXERSICE
Any person who exercised the profession in order of violation of the provision of the law in particular by working under a pseudonym, offering service to anyone who is not skilled to practice, exercising without a valid insurance policy: is illegally exercised the profession of architect.
An architect who is recognized guilty of illegal exercise of the profession is liable to an imprisonment of six days to six months and almond of two hundred thousand Francs to two millions Francs or one of this sentence will be executed.
The court may order the confiscation of material that has been used for a commission of offence and the closing of the office.
Any person recognized guilty of violation of the law has to immediately stop his activities.
