Supreme Court’s Sept 2025 ruling in Kiran v. Rajkumar upholds Section 18 SC/ST Act’s absolute bar on anticipatory bail if FIR shows prima facie offence—legally sound, no “mini-trials” allowed. Yet, doesn’t this clash with the provision’s protective intent against misuse? Could a liberal statutory interpretation empower courts to balance justice differently?

Allahabad High Court held that the bar under Section 18 of the SC/ST Act regarding anticipatory bail did not apply on application filed under Section 482 of the BNSS 2023.
