The Intellectual Property Institute of Canada (IPIC) is the professional association of patent agents, trademark agents, and lawyers practising in all areas of intellectual property (IP) law. Founded in 1926, IPIC has grown to more than 1,700 members, which include practitioners in law firms and agencies of all sizes, sole practitioners, in-house corporate IP professionals, government personnel, and academics. IPIC’s members support the Canadian economy by providing expert services to local, national, and international companies that are developing and growing their businesses. Members’ clients include virtually all types of Canadian businesses, universities, and other institutions that have an interest in IP in Canada or elsewhere, as well as foreign companies that hold IP rights in Canada.

100 years. One extraordinary legacy.

For a century, IPIC and its members have helped protect the ideas that move our world forward. From breakthrough inventions and life-saving technologies to iconic brands and creative works, intellectual property has played a vital role in shaping industries, economies, and everyday life.

This Centennial has been an opportunity to celebrate the people, milestones, and achievements that have defined our profession and strengthened Canada's innovation landscape.

But while we're proud of what we've accomplished together, we're even more excited about what's ahead.

New ideas. New challenges. New possibilities.

As we close this Centennial chapter, we look to the future with the same purpose that has guided us for the past 100 years: protecting originality, championing innovation, and helping turn imagination into impact.

100 ans. Un héritage extraordinaire.

Depuis un siècle, l’IPIC et ses membres contribuent à protéger les idées qui font avancer notre monde. Des inventions révolutionnaires aux technologies essentielles en passant par les marques emblématiques et les œuvres créatives, la propriété intellectuelle a joué un rôle de premier plan dans le développement des industries, des économies et de la vie quotidienne.

Ce centenaire a été l’occasion de célébrer les personnes, les jalons et les réalisations qui ont défini notre profession et renforcé le paysage de l’innovation au Canada.

Mais si nous sommes fiers de ce que nous avons accompli ensemble, nous sommes encore plus enthousiastes à l’égard de ce qui nous attend.

With increasing frequency, intellectual property professionals find themselves advising clients who wish to expand their businesses through franchising. However, many IP professionals are unaware of the nuances of franchise law and how these could impact a client's IP rights.

Key IP issues arise for both franchisors and franchisees at all stages of the franchise relationship, including IP-related disclosure obligations mandated by statute, and the desire to avoid contractual arrangements that could be deemed an "accidental franchise". Once a franchise agreement is terminated, franchisors must proactively de-brand and enforce their intellectual property rights to prevent any misuse by their former franchisee.

The session will cover:
▪️Overview of franchise legislation in Canada, including the consequences for failure to make adequate disclosure and how to avoid being deemed an accidental franchise
▪️Different types of IP in a franchise system and how each of these elements is addressed at the different stages of a typical franchise relationship
▪️Planning ahead for termination of a franchise agreement and enforcing post-termination obligations

L’histoire de l’IPIC a commencé au début des années 1900, mais l’évolution de la propriété intellectuelle ne s’est jamais arrêtée.

Au cours des deux dernières décennies seulement, de grands jalons mondiaux et canadiens ont transformé la façon dont les idées sont protégées, partagées et concrétisées.
