🚨 ATTENTION OCI CARDHOLDERS: Don't Fall Victim to Illegal Penalties! 🚨
If you're an Overseas Citizen of India (OCI) cardholder and recently had a baby in India, or are planning to, please read this carefully! We've received numerous reports of OCI families being wrongly pressured to pay exorbitant fines, sometimes up to ₹50,000, for "late registration" or "lack of exit permits" for their newborns. This is often an illegal demand, and you have rights!
📜 KNOW THE LAW: Rule 12(4)(d) is Your Shield!
Many officials at airports or Foreigners Regional Registration Offices (FRROs) are either unaware or misinterpreting the rules. However, the law is clear:
➡️ EXEMPTION: Under Rule 12(4)(d) of the Registration of Foreigners Rules, 1992, OCI cardholders are specifically EXEMPT from the requirement to register their newborn child within 14 days of birth.
➡️ NO EXIT PERMIT: Consequently, there is NO requirement for an "exit permit" or "exit visa" for the baby to leave India.
➡️ NO FINES: This means any demand for a penalty or late fee based on these grounds is ILLEGAL and without basis in law.
✅ WHAT YOU NEED TO DO (And What You Don't!):
DO THIS:
1. Notify Online: Once your newborn has received their Indian passport (if applicable) or foreign passport, you should update their details on the official OCI Miscellaneous Services portal. This is a notification process, not a "registration" that incurs fines.
2. Carry Proof: It is highly recommended to carry a printed copy of the relevant section of the MHA Gazette Notification (Rule 12(4)(d)) with you when traveling, especially at the airport. This is your immediate defense.
DON'T DO THIS:
You DO NOT need to register your newborn with the FRRO within 14 days if you are an OCI cardholder.
You DO NOT need to pay any "late registration" fines or "exit permit" fees for your OCI newborn.
🛑 FACING HARASSMENT? ESCALATE!
If you encounter an official demanding an illegal fine or an exit permit:
Politely but firmly quote Rule 12(4)(d).
Show them your printout of the rule.
If they persist, ask to speak to a supervising officer.
IMMEDIATELY ESCALATE the issue to higher authorities:
