The developer's appeal of council's decision to reject the Tannery application is before a Case Management Conference of the Ontario Land Tribunal this month.
No Clearcuts Kingston has made it easy for you to take this opportunity to participate. Please read below for step-by-step instructions. The deadline is THIS FRIDAY, FEBRUARY 10.
Please submit your OLT Participant Status Request and Statement by Friday, February 10th.
Easy Steps to participating in the Tannery Tribunal appeal without leaving home!
Step 1 - Open the OLT Participant Status Request Form / Statement form here
Step 2 - Fill in the Case Information
Tribunal Case No. - OLT-22-004597
Date of Case Management Statement / Hearing - 2023 / 02 / 21
Step 3 - Fill in your contact information
Step 4 - Write about your concerns with the proposed development on the Tannery lands
Possible example (please use your own words).
The 37-acre Tannery site is now a vibrant urban forest. I oppose the plan to cut down 1800 carbon-storing trees and fill in part of a Provincially Significant wetland. Such activity could disperse buried contaminants. So close to the shore is not the place for 8-storey buildings. The proposed development will have a negative affect on nearby Belle Island which is sacred to the Indigenous community and the UNESCO World Heritage designation of the Rideau River. Finally, it will not provide affordable housing.
Step 5 - Save the form
Step 6 - send an email to [email protected] with your completed form and any attachment (you could attach the letter you had submitted to the city in the summer, for example). You do not need to mail a paper copy.
Step 7 - do all this by Friday, February 10th at 4:30 pm at the latest.
Note: If you are able to get this done by noon Tuesday, please copy Kingston City Council and the City Clerk to your email as there may be a closed door meeting about this on Tuesday. Here's the email.

THANK YOU
for taking the time to show that you care about
the river, the trees, and the land.
We can do something about climate breakdown by speaking up!
Answers to two important questions
1. If I become a participant in the OLT appeal, do I have to attend the Case Management Conference (CMC) on February 21st?
You do not need to attend the pre-hearing after filling the participant form. However, we encourage you to do so to show your interest in the case. Your presence will send a message. There is a small chance the Member might ask you to confirm the information in your form.
The more people who attend the start of the Case Management Conference on February 21st at 10 a.m., the more we show the Tribunal the ongoing level of concern there is in Kingston.
2. Is this worth my time?
YES! The Tannery urban forest and wetland with their vibrant wildlife are the wrong places to build 1650 high-priced units, plus commercial and parking. There are equally central sites nearby that would be better for development, especially affordable. Kingston is predicted to be a future extreme heat zone. We need our forests and wetlands to protect us. This area is contaminated, but reckless clearcutting and soil exporting might do more harm than good.
This is the wrong plan for this irreplaceable forest and we all need to speak up to say so.
Your concerns matter!
Please write to the Tribunal.
