Rumours are flying that the UCP government is considering forcing teachers back to work with legislation. They might even use the notwithstanding clause to do so.
The courts have previously ruled that governments cannot force contracts on unions; they have to bargain and reach voluntary agreements. However, the notwithstanding clause is a part of the Canadian Constitution that allows the government to set aside the Charter of Rights and Freedoms.
This would be an unprecedented attack on public sector bargaining rights. If the UCP gets away with using the notwithstanding clause instead of bargaining with teachers, no government will ever agree to bargain with a public sector union again.
There are alternatives that the UCP could have used. They could have used the Disputes Inquiry Board mechanism in the Labour Code, which would have forced the parties into mediation.
But most of all, the UCP could have, and should have, engaged in bargaining with the teachers in a meaningful way. The UCP could have addressed the catastrophic funding crisis in our schools and funded education.
If the UCP uses the notwithstanding clause against teachers, they will be bringing CUPE and other working people into this dispute. They will be telling us that working people do not deserve the right to bargain their own wages and working conditions.
They will be telling working people that we don’t matter. We can never accept that from any government.
