🔍 When should I inspect my rental unit?

Before you move in, always inspect the unit carefully with your landlord. This helps you agree on any pre-existing damage and protects you from disagreements when you move out.

It’s also important to inspect the unit before you move out. This gives you time to fix any damage before the final inspection. Use your notes and photos from the first inspection as a reference. Always be honest about any damage you caused.

Doing inspections carefully can protect your security deposit and make moving in and out smoother.

💵 Can my landlord evict me for not paying rent on time?

Yes. You are responsible for paying your full rent on the day listed in your tenancy agreement. If rent is late, your landlord can serve you an eviction notice the day after it is due.

If your bank account doesn’t have enough money when rent is withdrawn, your landlord could be charged a non-sufficient funds (NSF) fee. You should pay them back as soon as possible.

Paying rent on time helps protect your tenancy and avoid extra costs.

Do I have to get tenant insurance?

Tenant insurance is not legally required in PEI, but some landlords may require it. If your lease says you must have insurance and you don’t, you could be breaking the agreement.

What does tenant insurance cover?

👕 Personal belongings
Replaces items like clothes, furniture, electronics, or even things stolen from your car.

💵 Additional living expenses
Covers costs if you must temporarily move out due to fire, flood, or other damage.

⚖️ Liability
Protects you if someone is accidentally harmed in your rental unit.

Tenant insurance can give you peace of mind and protect your belongings and finances.

📝 What if I didn’t sign a lease?

A lease is a written tenancy agreement, but even if you don’t have a signed lease, you are still protected under the Residential Tenancy Act.

Verbal or implied agreements are recognized and the statutory conditions still apply, like keeping the unit clean and the landlord keeping it in good repair.

If you don’t have a written copy of your agreement, you can ask your landlord for one. If they refuse, you can apply to the Rental Office using Form 2A - Tenant Application to Determine Dispute.

You still have rights, even without a signed lease.

💳 What information does a landlord need for a credit check?

A credit check helps a landlord see if a tenant has a history of paying bills and rent on time. Your consent is always required before your information is shared with a third party, like a credit reporting agency.

For a credit check, landlords usually need:
• Name
• Address
• Date of birth

They might also ask for extra details, like:
• Driver’s license
• Passport
• Employer’s name
• Tax information, income, or expenses

You have the right to know why they need the information, who else will see it, and if there is any risk of harm to you.

You can always ask questions or suggest other ways to show you can pay the rent.

Everyone has the right to rent housing without discrimination.

Discrimination means being treated unfairly because of your identity, beliefs, or background. The PEI Human Rights Act covers protections against discrimination.

Examples of discrimination:

🏡 Advertising a building as “seniors-only”

🐾 Charging extra rent for someone with a service animal

👶 Refusing to rent to someone with children or expecting a child

💵 Refusing to rent based on income source

Your landlord also cannot discriminate against you for filing a human rights complaint in the past.

If you’ve experienced discrimination or aren’t sure, contact the PEI Human Rights Commission for help and guidance.
