The Justice Centre announces that lawyers will appear before the Supreme Court of British Columbia this week on behalf of British Columbia resident Kristin Olsen, who is seeking judicial review of a British Columbia Human Rights Tribunal decision that ordered her to pay $10,000 for comments made during private conversations with a longtime friend.

The case arises from a dispute between Ms. Olsen and Terry Wiebe, who lived on Ms. Olsen’s property between 2014 and 2018. According to the Tribunal’s findings, the parties were longtime friends who also shared work and living arrangements before their relationship deteriorated.

Constitutional lawyer Marty Moore said the case raises important questions about the reach of human rights tribunals into private discussions between individuals.

“This case shows yet again an example of the BC Human Rights Tribunal overreaching to police speech,” said Mr. Moore. “It highlights the serious need for legislative reform to prevent private individuals from going through this punishing process on account of expressing their sincere opinions and concerns.”

The Justice Centre announces that lawyers have filed a Charter application on behalf of Calgary-based journalist and political commentator Cory Morgan, challenging the constitutionality of Siksika Nation’s trespass bylaw after he was issued two trespassing tickets for filming and publishing commentary about conditions on the reserve.

The application, filed in the Alberta Court of Justice, argues that Siksika Nation’s Trespass By-law violates section 7 of the Canadian Charter of Rights and Freedoms because it allows people to be convicted and even jailed for trespassing without any notice that they are unwelcome and without proof of intent of wrongdoing. The application also argues that the bylaw is overbroad and unconstitutional.

The Justice Centre announces that constitutional lawyer James Manson will appear before the Standing Senate Committee on Human Rights today at 3:00 p.m. ET to present concerns about Bill C-9, proposed federal legislation that would expand Canada’s hate speech and hate crime laws while removing longstanding protections for religious expression.

The submission argues that Bill C-9 would:
-repeal the longstanding “religious defence” in section 319(3)(b) of the Criminal Code;
-create vague and duplicative new hate-related offences;
-increase the risk of arbitrary enforcement against peaceful protests and public demonstrations; and
chill lawful religious discourse and public debate.

The Justice Centre announces that lawyers have sent a legal letter to the South East Cornerstone Public School Division (Board) on behalf of Lampman mother Tawney Johnson, who is calling on the Board to implement policies that protect the privacy, dignity, and safety of female students in school washrooms.

The legal letter concerns allegations that a 17-year old biological male transgender student has been permitted to use the girls’ multi-stall washroom at Lampman School, despite numerous female students expressing concerns that the current arrangement has left girls feeling unsafe, uncomfortable, and reluctant to use school washroom facilities.

Constitutional lawyer Allison Pejovic said, “Schools are expected to provide safe environments for their students. Girls should not have to endure a full school day fearful that a biological male student will be in the washroom with them. It is an invasion of girls’ privacy and is causing immense mental harm.”

42,344 Canadians call on Parliament to stop Bill C-22 surveillance legislation

BREAKING NEWS:

The Justice Centre announces that it has delivered a national petition signed by 42,344 Canadians from every province and territory calling on Members of Parliament to defeat Bill C-22, the federal government’s proposed surveillance legislation.

Justice Centre board member and constitutional historian Dr. John Robson formally presented the petition in Ottawa, warning that Bill C-22 would significantly expand state surveillance powers while undermining the privacy protections essential to a free society.

“Privacy is not a luxury in a free society,” said Dr. Robson. “Privacy protects freedom of thought, freedom of expression, freedom of association, and the ability of ordinary Canadians to live without constant monitoring by the state.”
