Breaking news from Kenya.

Today, Kenya's High Court ruled that nothing in Kenyan law bars the state from considering requests to change the s*x or gender marker on official documents like birth certificates, national IDs, and passports. Refusing to even consider these requests, the court found, breaches the Constitution.

The case was brought by transgender activist Audrey Mbugua Ithibu and fellow petitioners, in a fight that began back in 2010.

Justice Bahati Mwamuye quashed the earlier refusals and ordered the relevant state agencies to receive, consider, and decide the petitioners' applications within 60 days.

The court also said that, until Kenya puts a clear framework in place, applications like these should be handled one by one, fairly and without discrimination, weighing the relevant medical and legal information, and always in line with the rights to equality, dignity, and privacy.

For many transgender Kenyans, documents that match who they are can shape everyday safety: applying for a job, opening a bank account, seeing a doctor, or moving through daily life without harassment.
