What are the benefits of arbitration?

Arbitration proceedings are overseen by an independent arbitrator (rather than a judge or magistrate), who considers the evidence and arguments presented by the parties.

This means that it is a private, impartial, and flexible process that offers confidentiality, efficiency, and a cost-effective way to resolve disputes.

An arbitrator's role is to decide the dispute, not to facilitate the parties towards their own agreement.

In arbitration, an independent arbitrator or tribunal manages the process and considers the evidence and arguments presented by the parties.

The resulting decision, known as an arbitral award, is legally binding and generally enforceable in court. The arbitrator remains impartial and does not act for or advise either party.

Not every disagreement is a problem to eliminate. Sometimes it is the signal that an assumption, priority, or unmet need needs to be surfaced.

Constructive conflict becomes more useful when people can separate the issue from the person, listen for what is driving the position, and agree on a process for working through the difference.

That does not mean every conflict will resolve quickly. It does mean the conversation can become clearer, more deliberate, and more productive.

Good dispute resolvers don’t just know how to speak. They know how to listen.

Active listening is a fundamental skill in dispute resolution and one you can start developing while you’re still at university.

💡 Practical tip:
When someone is speaking, resist the urge to immediately formulate your response. Instead, focus on understanding what they’re saying and why it matters to them.

🤔 Ask yourself:
• What are they actually saying?
• What might be important to them?
• Is there something they haven’t said yet?

🫵 Your challenge this week:
In your next conversation, ask one follow-up question before giving your opinion or advice.
