NDIS Bill No. 2 - National Disability Insurance Scheme Amendment (Integrity and Safeguarding) Bill 2026 has now also passed the House of Representatives.

It has now passed both Houses of Parliament and will become law.

The NDIS (Integrity and Safeguarding) Bill 2025- aka NDIS Bill No. 2- has passed the Senate, making it a step closer to becoming law.

If it passes both Houses of Parliament, the Bill will:
➡️ Make not complying with a banning order a crime that can carry a max 5 yr jail term.
➡️ Make it a crime to deliver services that require registration without being registered- max 2 year jail term.
➡️ Increase fines for failures to comply with the Code of Conduct to $15m if serious misconduct results in death or serious injury.
➡️ Allow the NDIS Commission to issue anti-promotion orders on business misrepresenting how people can use their NDIS funds in advertising
➡️ Expand banning orders to include auditors, business advisors and consultants.
➡️ Stronger whistleblower protections.
➡️ Increase the NDIS Commission’s monitoring, compliance and enforcement powers.
➡️ Introduce mandated electronic claims forms
➡️ And more

Last week, the Senate Committee Inquiry recommended that the Bill be passed after receiving public submissions and holding a hearing. The Bill still needs to go through the House of Representatives.

Choice and control means you have a say in how your NDIS funding is used.

You can choose your providers, decide how and when supports are delivered, and change arrangements if something isn’t working. With Plan Management, you can use both registered and non-registered providers, as long as the support meets NDIS rules.

Your monthly statement is a snapshot of how your NDIS funding is being used.

It shows what invoices have been paid, how much funding remains in each category, and any future commitments. Reviewing your statement regularly can help you plan ahead and make informed decisions about your supports.

If something doesn’t look right, your Plan Manager can help explain it.

The prices set out in the NDIS Pricing Arrangements & Price Limits (PAPL) document are the maximum prices that providers can charge NDIS participants for specific supports.

The price you pay for a service should be agreed upon between you and your provider and you can negotiate a lower price than the "price limit".

The NDIS have released a new Operational Guideline: Social & Recreation Supports.

The new Operational Guideline can be found here:

These Guidelines give clarity to what can and can't be claimed using NDIS funding.

In terms of social and recreation support, it is important to remember the NDIS will fund the support you might need to take part in an activity, but generally they don't fund the cost of the activity itself ie. entry fee, or standard equipment required.

Understanding Your NDIS Budget

Your NDIS plan is divided into different budget categories, and each one has its own rules. Everyone’s plan is different and unique to their support needs.

Core Supports are usually flexible and can often be used across daily living supports.
Capacity Building funding is set aside for specific goals, such as therapy or support coordination.
Capital Supports are for items like equipment or home modifications and are very specific.

Understanding how each category works can help you use your funding more effectively and avoid unexpected issues later in your plan.

A Plan Manager looks after the financial side of your NDIS plan, so you don’t have to.

This includes paying invoices, tracking your budget, and providing regular statements so you always know where your funding stands. Plan Managers also help check whether invoices are NDIS-claimable before they are paid.

This means you keep choice and control over your supports, without the stress of managing payments and paperwork.

It is important to remember that Plan Management funding comes from its own budget, so you don’t need to take money away from your other supports to cover it.

• The National Disability Insurance Agency (NDIA) introduced Funding Periods in May 2025. Funding Periods have been rolling out gradually since then, so your plan may already include them, or they may be introduced in your next plan.

• A funding period is the time that part of a participant’s funding becomes available, and how long it needs to last. Participants can spend up to the amount of funding available in that time.

• Funding periods can vary in length, but these are most commonly set at three-month intervals. The NDIA determines the length and amount of each period based on your individual circumstances.

• Any unused funds will roll over to the following period.

• However, once you have exhausted the funds in a funding period, you cannot access funds from a future period until that period begins. For this reason, it is important to budget carefully within each individual period.

• Unfortunately, it is not possible to overspend in one period and then wait for the next period to pay outstanding invoices, as this defeats the purpose of funding periods.

• If you think you are at risk of overspending, or if you need additional supports earlier in your plan and less later on, you can raise this during the planning stage or discuss it with your NDIA contact.

• If you are not satisfied with the funding periods and total budget amounts in your plan, you can request an internal review.
