Qube has come out in opposition to high-risk licensing for maritime crane operators.

Every crane driver in our community holds a licence, yet Qube does not believe its employees, or other wharfies and seafarers in one of the most dangerous and dynamic industries, deserve the same standard.

Safe Work Australia must reject profit-first arguments from corporations that put workers’ lives at risk.

Recently Industrial Magistrate Kucera handed down a decision in favour of the MUA’s claim against MSS Security for engaging in wage theft and breaching the Security Services Industry Award.

The genesis of this issue evolved from suspicions of these workers being underpaid after resolving a similar claim against Wilson Security back in 2021.

Around this time, the MUA made a decision to back in security workers engaged at Pilbara Ports sites, as they had been left to their own devices by other unions with similar coverage.

After organising the workforce around Majority Support Determination to commence negotiations for an enterprise agreement, we then filed a claim for breaches of the Award.

Not long after this claim was filed, a second claim was made in respect to a further twenty-seven members, which will be finalised in due course.

MSS have fought us every step of the way, including turning up to the hearing with Senior Counsel, Junior Counsel and a full team of solicitors.

This matter has moved through the Courts which unfortunately takes a bit of time until on Monday 15th June, Industrial Magistrate Kucera handed down his decision observing that the MUA has established on the balance of probabilities, that MSS has engaged in the Award breaches as alleged and thereby contravened s.45 of the FW Act.

He was also persuaded that an order should be made under s 545(3) of the FW Act requiring the respondent to pay the affected member the sum of $50,725.32, being the amount by which he was underpaid because of the award breaches.

There will be further programming in respect to the issue of penalty.

This reflects the great work by MUA lawyer Sumayyah Sayed and our barrister, Oshie Fagir.

We expect an appeal to the Federal Court, and we will fight that through the Courts.

Last week our legal team filed its third unfair dismissal claim against JetWave in the last three months.

The feral cat attitude of JetWave lately has us completely lost as to how they really want to run their business.

Their conduct of recent in enterprise bargaining has been to consistently skirt around claims and cite that the current agreement is ambiguous.

Their proposal to remove any ambiguities instead saw them remove some forty-odd conditions the workforce currently enjoy.

If the company put this proposal out to vote it will be fiercely opposed.

After JetWave’s recent departure from Port Hedland due their service providers license being revoked, one would think they would be seeking to repair their image and get on with trying to create a safe and productive workforce. But no, not Jetwave, the cats out the bag and its gone feral

Maritime Union of Australia WA Branch Official, Jeff Cassar attended HMAS Stirling recently to meet with members on board Teekay-managed vessels, ADV Besant and ADV Stoker.

The discussions focused on disputes being run on behalf of members, leave in advance, company Drug & Alcohol policy, and various other broader issues including the potential relocation of Teekay-managed fuel tanker Absolute and a progress report on negotiations for Small Hulled Fleet enterprise agreements with Teekay Shipping and OSM/Birdon.
