Save the Myall Road Bushland and the Plants & Animals that live there Landcom is planning to tear down and build medium-density housing on the reserve next to the footy fields on Myall Rd, Garden Suburb.

This will be devastating to the many flora and fauna that reside in this area's last, large pocket of bushland.

Hey All

Just a reminder if you want to submit an objection to the rezoning of Garden Suburbs to allow for higher density time is running out and must be made by 20th of April.

It's disgraceful that Landcom promised that that a cap of 105 lots would be built in line with their approval by the Planning Panel and now they have gone back and are going to squeeze 69 housing units where there was meant to be 14. Yes it will be "affordable" rental housing and will change the character of the area with a minimum of 3 stories.

Have your say before they weasel a way to destroy all the bushland. Have your say of your concern is the increase of density which will have an impact on the remaining bushland, have your say if you think the parking is insufficient, or if you think the community should get better social infrastructure from the developer, although this exhibition is about the rezoning, so maybe focus on the fact that the planning panel already determined what was appropriate and that this rezoning should not be allowed. Landcom is calling it their Sugarwood project, I think that must be because they are killing sugar glider habitat, it should be called BS Wood, or maybe Powerful Owl Obliteration Project.

Submit your objections at https://pp.planningportal.nsw.gov.au/ppr/under-exhibition/garden-suburb-project until 20th of April Background- Landcom submitted their DA over a decade ago, 5 years ago the planning panel then assessed their proposal, and considered all the objections. The planning panel gave them conditional approval, with LOTS of conditions. FIVE years later they come back and totally go against their conditional approval and then seek to change Lake Macquarie Councils Local Environment Plan to put 69 units on two lots approved for 14 units by the planning panel. This makes a total mockery of the independent planning panel who assessed the proposal and put a cap of 105 housing units on this site because of the sensitive and high value bushland that surrounds it. It make a mockery of previous consultation that community put significant efforts in the consider and address. It makes a mockery of the previous reports provided to the community to consider the applicants development. Landcom has had 13 years to do this development and they still can't tell the community what the total development will look like. What the yield will really be. We want to know what Landcom is planning to do with Lot 69 before we can even consider the massive material changes to lots 67 and 68 that Landcom now desire to force on the community under the guise of affordable housing. Lot 67, 68 and 69 should be considered as one development and not portioned off to manipulate the rules because they know that will go over 75 lots and prevent them from using this trigger for self assessment. That's how they are getting around being transparent about the overall site. Landcom already just held a submission process that was poorly publicised and didn't event consult previous submitters regarding this development. Now we find out they actually have to change the local LEP to progress. Many people have just submitted objections against the development to Landcom and now we are supposed to do more submissions. This type of behaviour by a government associated body (Landcom), and endorsed with comments by local elected members (Jody and Yasmin) erodes community confidence and trust in community consultation and as mentioned, makes a mockery of NSW Planning Polices and environmental protection measures. Why be concerned I hear you say when we need more housing? There is already plenty of cleared land in the Hunter for the housing needs that we have without clearing and damaging more bushland. They have cleared 12 hectares already and now they are going to increase density which can be expected to have a negative impact on the remaining bushland surrounding the development. Landcom should be ashamed of themselves for how they have treated our local community for over a decade, how they have totally clear felled the site, how they have short changed the soccer club, how they were going to provide an off site off set and could not find a like for like one and decided to do an on site off set, how they have removed what could have been a strong visual buffer at the front of the site. Now they have come back right at the last moment and said, no, what we told you before is not what we are going to do. We are going to have 3 storey buildings here now and greater density and we are going to consolidate social housing into one location with what could be considered insufficient parking. To be honest, we are getting exactly what we expected from Landcom based on how they have treated the local community. Lake Macquarie Councillors are the only people who have let us down equally to Landcom.

Recently a letter went out to some houses to advise of a change proposed by Landcom to their conditionally approved development.

Incredibly Landcom can propose the new changes, increasing density, potentially doubling the lots and THEY are also, the consent authority. This is totally against a fair due process, the developer proposes the idea to themselves and then considers their idea and makes a determination! Has there ever been a more appropriate use of the term of "dracula being put in charge of the blood bank"

Bored yet? Well basically they are going to build 69 untils at least 3 stories high on two lots at the front of the development where the planning panel approval from 2020 says they can only build 14.

The Joint Regional Planning Panel in their decision in 2020 limited the development to a TOTAL of 105 lots/or housing units. This was due to the sensitive nature of the surrounding bushland, and this is the approval given for the development to progress.

BUT NO, now Landcom has a weasel way to go against the existing consent.

Lot 68: 30 apartments and 6 terraces
37 residential parking spots which are in accordance with the requirements as set under the State Environmental Planning Policy (Housing) 2021 (Housing SEPP)
sustainability: aligned to a 4-Star Green Star rating
THIS ALSO MEANS THEY CAN COME BACK AND DO THE SAME FOR LOT 69
on the north side of Myall Road, in fact they could propose up to 75 housing units on Lot 69. This could result in a total of 210 housing units/lots instead of the approved 105.

Of course feel free to contact any of the local elected people who should give a stuff about protecting our local bushland but don't really care. So you can contact Lake Macquarie Councillors, Lake Macquarie Council themselves (who will tell you, "it's up to Landcom...we're not the approver" but Lake Macquarie City Council and Lake Macquarie Councillors gave their approval to this bushland destruction back in 2020 when they could have stopped it happening.)

Wrap Up Gathering
Hi All

We are winding up Save Myall Road Bushland as an Incorporated Association. The committee voted in favour of this. We thought we'd have a get together one more time to say well done and thanks to all those who were involved and we will be donating remaining funds to Hunter Community Environment Centre.

So on Friday 5 December, from 5:30pm we will meet at Warner's Bay Podium area, unfortunately the music performances are not on until January. Anyway, let's still catch up with each other, enjoy the view and share some nibbles and drinks. Bring a fold up chair or a blanket or not

No fuss getting there at 5:30, just drop in, we will be there until 8pm.

Hey All

Apparently Council is meeting at Morisset Showground from 6:30pm tomoz (mon 26th) and I have been advised that Council may discuss the Myall Rd and Gymea intersection.

If you are passionate about this intersection then you may want to contact Cr Griggs or Cr Adamthwaite and offer them your thoughts about the intersection, like we have never been consulted as a community about the planned traffic lights/ no public exhibition period which you would expect. OR you could go to the meeting. Just FYI

It's last day for submissions on Newcastle Council website to offer your support to the protection of hundred as of hectares of bushland . It is a very easy process to comment. Follow the link and tell them you support the changes to the status of this land in the western corridor in the local strategic planning statement.

Reasons: to protect biodiversity, to save green spaces, to better balance development and environmental protection etc etc

Have your say on the LSPS update addressing the biodiversity value of land in the Western Corridor and long-term planning for the Summerhill Waste Management Centre.
