Denman Aberdeen Muswellbrook Scone Healthy Environment Group : DAMS HEG v MACH Energy

This fundraiser is being run in support of the Denman Aberdeen Muswellbrook Scone Healthy Environment Group. All funds raised will be used for legal costs associated with the High Court case, and to support DAMS HEG’s campaign for a safe climate and just transition.

Last year, DAMS HEG's Tony and Wendy helped secure a ground-breaking legal victory when the NSW Court of Appeal rejected the proposed expansion of the Mt Pleasant coal mine.

The ruling is already changing how new fossil fuel projects are assessed in NSW — particularly around whether decision-makers properly consider the full climate impacts of coal projects, including emissions caused when exported coal is burned overseas.

Now, MACH Energy is appealing that decision in the High Court.

If the coal company succeeds, it could weaken one of the most significant climate rulings Australia has seen in years.

Tony and Wendy have spent four years fighting this case through three different courts — not as politicians or professional activists, but as local community members trying to protect the places we all call home.

Their property sits beside the Mt Pleasant mine on Wonnarua country in the Hunter Valley, where communities have already experienced worsening droughts, bushfires, and floods linked to climate change.

And this case is being taken seriously around the world. Four prominent climate law and science institutions from around the globe have been granted leave to be heard as amici curiae (friends of the court) in this watershed moment in Australian legal history.

Tomorrow’s hearing will shape how fossil fuel projects are approved across Australia now and for years to come.

But taking on a coal giant in Australia's highest court is not cheap. And Wendy and Tony need your help.
