The Working Women's Centre South Australia is celebrating a historic Federal Court win in a workplace sexual harassment case. Our client Elisa came to us more than three years ago as a single mum, and an apprentice carpenter who experienced sexual harassment while working in the construction industry.

The judgment is the first fully contested Federal Court case to consider the workplace sexual harassment protections introduced into the Fair Work Act 2009 in 2023. It is also a major milestone for the Centre, marking our first Federal Court case.

Elisa showed extraordinary courage and determination, pursuing justice through a challenging legal process that lasted more than three years. By speaking up, she has held her employer accountable and paved the way for others to challenge cultures of sexual harassment.

This decision provides guidance on the new workplace sexual harassment protections and sends a strong message that workplace sexual harassment will be taken seriously.

“The Court accepted the complainant’s evidence in circumstances where there were no other witnesses to the conduct. The Clarke decision sends a powerful message to sexual harassment perpetrators that women will be believed, and perpetrators can be held to account even where the misconduct occurs in an isolated or private setting.” said Nikki Candy, CEO of the Working Women's Centre SA.

⚠️ WARNING: This video contains distressing content.

Too often, non-disclosure agreements (NDAs) are used to silence workers, preventing them from speaking about their experiences and allowing harmful behaviour to continue unchecked.

Guided by lived experience and supported by evidence, the Our Silence Is Not For Sale campaign by the Working Women’s Centre Australia highlights the real impact of NDAs in cases of workplace sexual harassment and discrimination.

Through personal stories and research, the campaign exposes the misuse of NDAs and calls for meaningful reform. We are advocating for stronger protections to ensure that confidentiality is a choice for workers, not a condition imposed on them.

Join us in ending the misuse of NDAs and building safer, more transparent workplaces.

Not In Our Name (NION) has recently launched in Australia. This is a movement of women who are uniting in support of trans people. Thousands of women have already added their names, as part of a campaign to defend the S*x Discrimination Act against attacks from anti-trans groups.

Not In Our Name calls on all women who support the trans community to add their names to an open letter and stand for inclusion, respect and equality.

The NION campaign in the UK has seen more than 100,000 cisgender* women sign an open letter rejecting the weaponisation of women’s experiences to justify the exclusion of trans people.

If you agree that those who target and marginalise trans people do not speak for all women, add your voice and help create a kinder, more inclusive Australia.

If you would like to add your voice, sign the open letter here: https://actionnetwork.org/forms/nionwomenaus/

*cisgender refers to someone who is not trans

Our team came together to mark National Reconciliation Week (NRW), a time to reflect on Australia’s history, recognise the ongoing impacts of colonisation, and consider how we can all contribute to reconciliation through our actions, relationships and workplaces.

National Reconciliation Week is held each year between two significant dates in Australia’s history: the anniversaries of the 1967 Referendum (27 May) and the Mabo decision (3 June). This year’s theme, All In, is a call for all Australians to step off the sidelines and commit to reconciliation every day through actions that create meaningful change.

As part of the week, our team screened the short documentary Servant or Slave (2016), which shares the stories of Aboriginal women who were forced to work in domestic servitude. This screening was followed by a presentation from Dr Natalie Harkin, Narungga woman, Research Fellow in Critical Indigenous Studies at Flinders University and author of the book Apron-Sorrow / Sovereign Tea (2025).

We’re grateful to Dr Natalie Harkin, the Unbound Collective and all the Aboriginal women and families who continue to tell these stories. The unfinished business of stolen wages must be grappled with, as part of ongoing reconciliation efforts. Working Women’s Centre SA is committed to taking action towards meaningful change for reconciliation and justice.

The documentary Servant or Slave is available to view on SBS.

This week the Working Women’s Centre team took part in the SIN's S*x Worker Awareness Training delivered by Brass. This free training session is available for service providers and community groups, and anyone interested in creating safer, welcoming, and non-stigmatising spaces for s*x workers. We highly recommend this excellent and informative workshop!

The WWC SA supports the decriminalisation of s*x work in South Australia where we currently have the most punitive laws in the country. S*x workers deserve industrial rights and recognition. Find out more about SIN and their campaigns, services, and training at sin.org.au
