| Public-Private Partnerships are increasingly shaping strategic investments and public service delivery across the region. Ensuring sustainable monitoring of PPP contracts is essential to strengthen transparency, accountability, and the protection of public interest.

This publication presents practical insights and reflections from the Dutch experience in monitoring PPP contracts. It provides useful perspectives for public institutions, civil society, media, and other stakeholders working to enhance public oversight and informed debate.

What does it take to build trust in public contracting?

During Week of Integrity Albania 2025, the panel “Building Capacities for Sustainable Monitoring of Public Contracts”, implemented under the joint project of and , supported by the through the MATRA programme, brought together institutions, experts, and partners to reflect on how 🇦🇱 Albania can strengthen transparency, accountability, and integrity in public contracting.

| Building Capacities for Sustainable Monitoring of Public Contracts

The panel discussion, organized as part of the and supported by the , was opened by H.E. Reinout Vos and explored concrete ways to strengthen oversight mechanisms through stronger institutional capacity, civic engagement, data transparency, and alignment with the EU acquis.

As part of the Strengthening the Monitoring of Public Contracts project, implemented by CLE - Centre for Legal Empowerment and Albanian Institutes for Research, the panel brought together key institutions and experts for an in-depth discussion on how Albania can build a more transparent, accountable, and integrity-driven public contracting system.

Under the moderation of Erla Mehilli, panelists, Asoc. Prof. Juelda Lamce, Adi Qose, Reida Kashta, Franc Terihati, and Dr. Rianne Warsen shared perspectives on:

➡️ The contribution of civil society to contract monitoring.
➡️ Challenges in the criminal prosecution of public-contract cases.
➡️ The role of parliamentary oversight in PPPs.
➡️ The importance of procurement alignment under Chapter 5.
➡️ Lessons from the Dutch model of PPP monitoring and administration.

The discussion reaffirmed the importance of integrity, collaboration, and evidence-based oversight as essential foundations for public trust. The insights shared will directly inform ongoing efforts to establish the Public Contracts Observatory, contributing to a more open, transparent, and accountable public procurement environment in Albania.

Më 7 nëntor, zhvilluam një tjetër PPP Talk tek GoGo.al, në kuadër të projektit “Strengthening capacities for the sustainable monitoring of public contracts”, mbështetur nga programi Matra 2024 i Ambasadës së Mbretërisë së Vendeve të Ulëta në Shqipëri.

🔍 Diskutimi u fokusua mbi Partneritetet Publike-Private (PPP) dhe rolin e tyre në nxitjen e transparencës, llogaridhënies dhe menaxhimit efektiv të kontratave publike.

📚 Pjesëmarrësit u njohën me mjete praktike për monitorimin e kontratave PPP, përfshirë:
✅ Lidhjen e pagesave me performancën
✅ Menaxhimin e riskut
✅ Transparencën financiare dhe përputhshmërinë kontraktuale
✅ Rolin e shoqërisë civile në mbikëqyrje

On 7 November, we held another PPP Talk at GoGo.al, as part of the project “Strengthening capacities for the sustainable monitoring of public contracts”, supported by the Matra 2024 program of the Embassy of the Netherlands in Albania.

In collaboration with Epoka University, Assoc. Prof. Dr. Bojana Hajdini, an interactive session was held with law students to introduce the Public Contract Monitoring Project — an initiative that will lay the foundations for Albania’s first Public Contracts Observatory. ⚖️💼

During the training, students explored:
📘 The Manual for Monitoring Public Contracts, developed by the project’s experts
🔍 The methodology for effective contract monitoring and the value of open data
💡 The role of young legal professionals in advancing transparency and integrity in public life

Today we held a training session with the organization Shoqata Together for Life, as part of the project “Strengthening capacities for the sustainable monitoring of public contracts”, under the Matra 2024 program.Embassy of the Netherlands in Albania

🔍 During the session, we discussed Public-Private Partnerships (PPP), with a special focus on their impact in the healthcare sector – an area where PPP contracts have a direct influence on the quality of services and citizens’ access to healthcare.

📚 Practical tools were presented for evaluating PPP contracts, analyzing:
The link between payments and performance
Proper risk management
Financial transparency and contractual compliance
The role of civil society in monitoring public contracts

Gjykata e Lartë konstaton shkeljen e afatit të arsyeshëm të një procesi të zgjatur padrejtësisht prej vitesh!
⚖️ Gjykata e Lartë ka pranuar kërkesën e shtetasve G.J. dhe F.J. përfaqësuar nga avokatët e Qendrës “Centre for Legal Empowerment”, duke konstatuar shkeljen e afatit të arsyeshëm nga Gjykata Administrative e Apelit Tiranë.
📌 Kërkuesit iniciuan çështjen gjyqësore në vitin 2016 pranë Gjykatës Administrative të Shkallës së Parë duke kërkuar shpërblim për dëmin pasuror dhe jopasuror të shkaktuar nga prishja e paligjshme e banesës së tyre. Gjykata vendosi pranimin e pjesshëm të padisë dhe detyrimin për ti shpërblyer dëmin pasuror në vlerën 3 485 000 lekë dhe dëmin moral në vlerën 300.000 lekë për dëmin e shkaktuar. Ky vendim u ankimua dhe megjithëse kanë kaluar gati 5 vite, ende nuk është caktuar një datë gjykimi nga Gjykata Administrative e Apelit Tiranë, duke cënuar të drejtën për gjykim brenda një afati të arsyeshëm.
Pavarësisht se pala kërkuese ka paraqitur kërkesa për përshpejtimin e gjykimit të çështjes, gjykata nuk ka shqyrtuar çështjen, duke cënuar kështu të drejtën e kërkuesve për një gjykim brenda një afati të arsyeshëm.
