DOES THE RECESS PERIOD FORM PART OF AN ACADEMIC TERM?
You thought recess meant the term was over? The Guild Judiciary just said, think again.

BACKGROUND
The Disciplinary Committee of SHAS, led by its Chairperson Mr. George Nyirenda approached the Guild Judiciary seeking an interpretation of an academic term used in the SHAS Constitution and the CBU Academic Calendar. The question was straightforward but practically important: Does a University Term end on the last day of classes, or does the recess period that follows still form part of that term?
This question had direct implications for SHAS's disciplinary timelines and by extension, for every student organisation operating under the Guild.

1. Did the Guild Judiciary have the jurisdiction and authority to hear this matter?
2. Does the recess period form part of a University Term?
RULING OF THE GUILD JUDICIARY
1. On Jurisdiction
The Guild Judiciary held that while it does not have general powers to interpret the Academic Calendar as a standalone document, but rather it holds incidental jurisdiction to do so where such interpretation becomes necessary for the proper administration of student Guild affairs. Since SHAS is a student organisation registered and operating under the Guild, its disciplinary matters squarely fell within the Judiciary's competence.
2. On Whether Recess Forms Part of an Academic Term
The Guild Judiciary examined the official CBU Sessional Dates for 2025/2026 and held that term 1 ran as one continuous block, from 24th November 2025 all the way to 7th March 2026. The recess sat inside that block, listed within the term's own timeline, not after it. Nowhere does the Calendar say "Term ends, then recess begins." Recess is simply one of several milestones alongside classes and examinations occurring within the life of the term.
The conclusion? Recess is a scheduled institutional pause within a term. The term never stopped. You just stopped having classes. Recess is part and parcel of a University Term for all intents and purposes.
