The Property Practitioners Regulatory Authority (PPRA) can impose a maximum fine of R25,000 per contravention for an agency operating unlawfully or without a valid Fidelity Fund Certificate (FFC)
THE PPRA HAS BECOME YOUR KRYPTONITE.
In yesterday's webinar, Adv Debra Vial once again addressed the issue of agencies and practitioners operating under the banner of being "Powered By" another entity.
The warning was clear:
"Powered By" has no legal standing in the Property Practitioners Act.
According to Adv Vial, practitioners and entities operating under these arrangements should take note, as the PPRA has indicated that sanctions may follow where non-compliance is identified.
For years, many have assumed that adding the words "Powered By" somehow creates legitimacy or compliance. The reality is that compliance is not determined by marketing terminology, branding, or industry practice. It is determined by the law.
The uncomfortable truth is this:
You may think you're a Super Agent.
But if your business model relies on a structure that the PPRA does not recognise, then your Kryptonite is the PPRA.
Now is the time to review your operating model, your branding, your mandates, and your compliance obligations before the regulator does it for you. [email protected]
Ignoring regulatory warnings has never been a successful compliance strategy.
