Immigration Voice Announces Victory for Right to Work of Spouses (H4 EAD) of Immigrants Stuck in the Discriminatory Green Card Backlog

August 2, 2024 (Washington, DC) — Immigration Voice, a national non-profit organization with over 130,000 members that advocates for the alleviation of restrictions on employment, travel, and working conditions faced by legal high-skilled immigrants in the United States working as doctors, researchers, scientists, and engineers at many of America's Fortune 500 companies announces that it has successfully litigated in Court to preserve the right of spouses of H-1B visa holders currently stuck in the discriminatory green card backlog to work in the United States.

In the case of Save Jobs USA v. U.S. Department of Homeland Security, D.C. Circuit (Case Number 23-5809)—a group called Save Jobs USA sued to eliminate work authorizations for approximately 100,000 new H-4 visa holders claiming that this work authorization was illegal. The Court ruled in favor of Immigration Voice and dismissed this lawsuit, stating that “decades of executive-branch practice, and both explicit and implicit congressional ratification of that practice” support the H-4 EAD.

In 2017, before any other group had intervened in any other litigation during the Trump Administration—Immigration Voice moved to intervene in this lawsuit to prevent the Trump Administration from settling the case with Save Jobs USA and making H-4 employment authorizations illegal forever. Immigration Voice had been told by Big Tech company lawyers that intervention would be impossible, but it ignored their incorrect advice and successfully intervened in the case anyway.

It was only because Immigration Voice intervened in this case that H-4 employment authorizations were saved for an estimated half a million backlogged families who have benefitted from the H4 EAD program since 2017. After doing this, these same Big Tech company lawyers who told Immigration Voice they could not intervene then copied Immigration Voice’s strategy and moved to intervene in many other cases, but they would not lift a finger to help their employees currently stuck in a backlog spanning more than 170 years.

Today, the DC Circuit affirmed the District Court’s decision saying that the H-4 EAD program is legal and beneficial.

Aman Kapoor, the Co-Founder and President of Immigration Voice stated: “We are thrilled that the Court agreed with our view that the law allows spouses of people here in the United States suffering in decades-long green card backlogs caused by National-Origin based discrimination to at least have the right to work in the United States while they wait in these discriminatory backlogs. This case shows why Immigration Voice is necessary, as no one else was willing to step up to help this backlogged community suffering from discrimination, and Immigration Voice was the only organization willing and able to take the risk of acting to help the families in the green card backlog.”

IMPORTANT ANNOUNCEMENT!

ADVOCACY EVENT IN DC IN 2022

For those of us who understand the process, we know that we live in the participatory democracy. However, we also know all too well that nothing happens by itself even in a democratic system.

Just because something is wrong, doesn’t make it necessary that it shall change. That’s how the participatory democracy is supposed to function so people who want to see the system change have to work towards that change to make themselves deserving of the change they seek.

Likewise, just because we are being treated unfairly and we are being exploited by the employers and immigration lawyers, it is not sufficient for the system to change by itself. And only those who make themselves deserving of the change will be able to improve the conditions of their lives so they are not exploited and can live free.

If you want to make yourself and your family members deserving of equal treatment and fairness, then let us show you how, because we know a way, which is tried and tested, and it works. It works because the proof is that we have been able to get the bill through the House and the Senate in the past. Our opponents insisted the bill will never pass the Senate and the House, but we made it happen with our strategic grassroots efforts! With your help, we can do that again so the President could sign it into law.

Over the past two years our grassroots volunteers were actively engaged in advocacy but were constrained by the pandemic to phone calls and virtual meetings. With your efforts, H.R. 3648 – Equal Access to Green cards for Legal Employment (EAGLE) Act of 2021 was introduced with bipartisan support by Representative Zoe Lofgren and Representative John Curtis. The bill already received a hearing and it is marked-up in the House Judiciary Committee. The next step is the vote on the House floor and then the vote in the Senate.

Our members have been asking us “Can we do more to get H.R. 3648 passed into law”? With the constraints on in person meetings due to the pandemic lifted, we can now tell you “Yes, you can do so much more!” As we expect the bill to come to the House floor for a vote, we need our grassroots to step up and make their voices heard.

Many of our members have been raring to take their advocacy to the next level. That time is now! One of the most impactful tools in advocacy is the face-to-face meetings with your Congressional members and their legislative staff in Washington D.C.

Immigration Voice will hold its first public Advocacy event of 2022 from June 12-14 in Washington D.C. We expect to have over 350 Congressional meetings to push for turning this bill into law. We invite you- the like minded interested members who care for the passage of this bill to our 3-day Advocacy event. At this event you will learn from experienced advocates who will provide you with tools and training to effectively advocate for the passage of the bill. You will also learn the behind-the-scenes intricacies about the bill’s progress from experts. Even if you have never participated in the past, you can change, and you can and should speak for your family.

This week, the U.S. House Judiciary Committee (HJC) will markup and bring up for vote the EAGLE Act (H.R. 3648) – the bill to remove the discriminatory per country limits on Green Cards.

Dear Friends,

We are happy to share with you that our bill H.R.3648 - The EAGLE Act will be marked up in the House Judiciary Committee on Tuesday, April 5th 2022.

Preparation is a key ingredient for success. And in anticipation of the vote in the House Judiciary committee, key leaders of Immigration Voice have been in Washington DC for the last two weeks to speak with House Judiciary Members and their staff. As always, we have broad bipartisan support for the bill and we expect that with your active participation we will together see the bill pass the House Judiciary Committee next week, and pass on the House floor soon after.

We have often shared with you the old adage that the legislative process is like a glacier. On the surface it appears as if nothing is moving, but the glacier is slowly but surely moving towards the ocean while grinding away at the obstacles underneath. We share your pain due to the slow pace of the legislative process, but there is only one ultimate outcome here - per-country caps on employment based Green Cards are discriminatory, racist and amoral and the Congress must do the right thing to remove per country caps.

We salute our members for their quiet but intensive efforts over the last few months, especially in the last few weeks, to prepare for this markup. This is particularly true of many of our long-time members who already have Green Cards, but they continue to lead this fight for fairness and justice, taking time away from their lives and busy schedules to fly down to DC and make sure members of the House Judiciary Committee are well informed about the EAGLE Act.

Going forward, firstly, we need you to get ready to step up to get the bill through Congress - especially the Senate, which is the real hurdle. But we truly believe that the bill can and will pass the Congress this year. Please stay tuned for action items!

Secondly, we need you to start a recurring contribution at a level you are comfortable with at donations.immigrationvoice.org. There is no way we would have been able to get to where we are today without the help of our lobbyists and specialized advisors. We need to be able to continue to retain their services in order to keep moving our bill forward, which requires funds.

While it can be very frustrating to watch a glacier-like slow legislative process unfold, please know that the work is constantly underway behind the scenes and the glacier is constantly grinding down obstacles. Even though a lot of us share the pain from the last Congress with the let-down after the House failed to pass the bill after the Senate unanimously passed it, the silver lining is, we did make significant progress by getting the bill passed through the Senate unanimously. And this year we will continue our collective work on the progress from the previous Congress.

We believe we are very close to getting our bill done in this Congress provided everyone in the backlog steps up to do your share with your participation and resources at this critical time.

We are doing our share, we need you to do yours.
