SUSTAIN SJ FILES SUIT OVER IMPROPERLY APPROVED AI DATA CENTER

FOR IMMEDIATE RELEASE —

Sustain SJ, a nonprofit group comprised of South Jersey residents, has filed a lawsuit seeking to overturn the City of Vineland Planning Board’s approval of an AI data center.

The City of Vineland Planning Board held two public hearings on August 5th and August 17th, 2026, and approved DataOne USA LLC's application for their final, amended site plan to constructan AI Data Center in Vineland, NJ. The complaint alleges that the Planning’s Boards approval was unreasonable due to the overwhelming expert testimony and evidence that the application’s proposed stormwater management system did not comply with applicable New Jersey statutes, regulations, and municipal ordinances, which could result in the depletion of the groundwater aquifer relied upon by the residents’ of Vineland, potentially create localized flooding concerns, and otherwise negatively impact Vineland residents water supply.

The complaint follows the New Jersey Department of Environmental Protection’s issuance of a $1.07 million fine in September against DataOne for operating up to 62 natural gas generators without permits. DataOne also received stop work orders regarding a 1.5-million-gallon LNG storage tank and the installation of Bloom Energy fuel cells; both were presented in the August hearings.
