Knowing Your Rights: Legal Protections for Everyone
Every person in the United States—regardless of immigration status—has constitutional rights. These rights apply equally in Tulsa, Oklahoma, as they do anywhere else in the country. Women of diversity, especially those from immigrant backgrounds, should be aware of these key protections:
1. The Right to Remain Silent
No one is required to answer questions about immigration status, birthplace, or how they entered the country. A calm statement such as “I choose to remain silent” is a lawful and protective response. This right applies during traffic stops, workplace visits, or home encounters.
2. The Right to Refuse Entry Without a Judicial Warrant
ICE agents cannot enter a home without a warrant signed by a judge. Administrative warrants (often labeled “ICE warrants”) do not grant entry rights. Always ask to see the warrant through a window or door before opening. Verify that it includes a judge’s signature, the correct name, and address.
3. The Right to Legal Representation
