The lawsuit protecting TSA officers’ union contract just got a new court timeline. A lot of people are going to say that means officers are protected.

Here is the part that is worth understanding: the lawsuit and the Gold+ privatization program run under completely different laws. One protects your contract. The other determines whether your airport converts to a private company.

Every time you swipe in at the start of your shift you are making a daily certification under TSA policy that you are fit for duty, ready and able to meet your work obligations. That has always been true under federal law. What changed on May 4 is that the swipe-in is now the explicit operational mechanism of that certification.

That change matters more now because of what else took effect on May 4. The Annual Medical Certification program and the daily fitness for duty certification operate under the same statutory authority and address many of the same conditions. Officers making disclosures on the AMC questionnaire are also certifying fitness every shift.

The Secretary of Homeland Security described the future of your checkpoint this week before Congress. He did not call it Gold+. He did not have to.

Asked about TSA modernization, Secretary Mullin told the House Committee on Homeland Security: “The top 10 of the top 20 airports that operate within the United States is actually privately ran TSA agents where we reimburse ‘em for, but we only reimburse ‘em for personnel. What we’re doing now is we’re going to roll that out even further and partner with public companies, private companies to be able to bring in technology and have it run smoothly.”

The current SPP airport list does not match that description. TSA’s private screening program today operates primarily at smaller regional airports, not the nation’s busiest hubs. Either the Secretary misspoke or he was describing something broader than the existing program.

Deputy Secretary Edgar added that the passenger security fee redirection would fund technology to help screen for FIFA and beyond.

The government is giving away 104 terabytes of federal security data to private tech companies and letting them keep 100 percent of the profits.

We went inside the draft DHS data agreement closing for public comment June 17. The fine print reveals that private vendors get free access to millions of federal bag and body scans to train commercial AI, but the government retains zero ownership of the resulting technology. Furthermore, if these algorithms fail or glitch at a live checkpoint, the agreement explicitly disclaims federal responsibility, leaving a massive legal black hole.

The government is giving private companies access to federal airport screening data.

Under a new agreement open for public comment until June 17, the companies keep the algorithms they build with it. The government gets nothing.

This is the final piece of an architecture that has been assembled quietly over the past year. Private money is funding the equipment. Private companies are building the network. Private contractors will run the checkpoints.

TSA officers worked 119 days without pay while this was being put together.

Against Giants documented Gold+ in August 2025. We placed the first national story with Federal News Network in April. We attended TSA’s Industry Day this week as a registered participant and published a full briefing for the officers we serve the same day.

Most TSA officers have never heard of the job search requirement that follows a Not Medically Qualified determination. Most don’t know the disability retirement option exists. Most don’t know how OWCP intersects with what comes next.

Here is what the primary source documents establish. Upon a Not Medically Qualified determination, TSA issues a Job Search Options Letter to the officer. Whether reassignment can actually result from that search depends on a disability determination under HCM Policy 339-2 and the ADA framework. If a job offer is made, the officer has seven calendar days to respond in writing. Silence is treated as a declination.

Memorial Day is a day set apart to honor the men and women who gave their lives in service to this country. Not their labor, not their politics, not their sacrifice measured against anything else. Their one and only lives, freely given.

Today, Against Giants Labor Advocates attended TSA’s Gold+ Industry Day as a registered participant. TSA leadership briefed vendors and airport executives on timelines, contracts, workforce transitions, and the innovations they are hoping to see at America’s airports.

What was said in that room matters for every TSA officer in the country.
