BAD H**P REGULATION ALERT: California's Department of Food and Agriculture (CDFA) is requesting comments on their new proposed fee structure for H**p cultivation by 5pm Thursday August 26. PLEASE SEND AN EMAIL TO: industrialh**[email protected]
These per acre fees are outrageous. The average fiber mill will require 1500 to 5000 acres of h**p per year to fill its capacity. The permit fees associated with this acreage is $250,000 to $750,000 per year! This will most certainly chase fiber and grain h**p out of our state. Greenhouse cultivation of CBD h**p will rise to $6000+ per acre.
Send an email AND THEN call your state legislators to express your opposition. Letters of Opposition are CRITICAL. This is obviously meant to further disadvantage h**p in the market. Please make your opposition known and ask for NO PER ACRE FEE FOR H**P CULTIVATION. The state should not balance the budget shortfall on the backs of h**p farmers and kill the fiber and grain market before it can establish itself.

For anyone in the CBD dietary supplements or cosmetics business, this new bill (S. 4348), the FDA Safety and Landmark Advancements (FDASLA) Act, being marked up in the US Senate Health Education Labor and Pensions (HELP) Committee is heading for passage will be devastating. It grants the FDA broad power to kill any product before it goes to market by withholding their approval of the product (for instance if it contains a product they don't like or consider "unlawful") The FDA's longstanding hostility to CBD is well known and this bill is so poorly drafted with imprecise language and duplicative rules that its bound to make it more difficult, if not impossible to bring new CBD products to market. Have a read and see for yourself. The two biggest dietary supplements groups NPA and American Herbal Products Association (AHPA) are vociferously opposed! Letters and phone calls to the US Senate and to the US House (if the bill passes the Senate) will be necessary to stop this disaster. H**p Fiber offers so many opportunities to benefit our economy. Beyond all the incredible products that are being created from h**p, a single acre of fiber h**p can absorb more than 11 tons of carbon per crop cycle of 4-6 months. That's as much carbon as 2 average cars put out every year.

Many of the problems faced by the h**p industry can reasonably be blamed on the inaction of the FDA. This piece, and the bigger investigative piece by POLITICO (link in the opening paragraph), are most definitely worth a read. From the overproduction of cannabinoid h**p in anticipation of a favorable FDA categorization of CBD as a dietary supplement (allowing it in food and beverages) to the development of problematic optical isomers like delta 8, delta 10 and HHC, which are made in the lab from CBD isolate produced by farmers hoping to get ahead of the market, the FDA's dysfunction is hurting H**p. Reading these illuminating articles you will see what other problems are being caused by the FDA's incompetence.
With states like working hard to choke the h**p industry with bad law and with high taxes and inept regulations causing an potential mass "extinction event" for regulated THC cultivators, is there any solution in sight?
Is it possible for executive agencies like CDFA, DCC, DPR and the FDA/USDA to be judged based on competence rather than just on "intentions"? Its time to hold our legislators to account and require them to do their oversight jobs and take a break from Cable News gabbing.
