City Council tonight will vote on whether to approve the vacation of 2.6 acres of Deer Valley Drive in order to facilitate development at the Snow Park base of Deer Valley Resort. Public input over the last 15+ months has indicated strong support for development of Snow Park as Deer Valley owns the rights for said development. However, Deer Valley's current proposal requires a right of way (ROW) vacation for a portion of Deer Valley Dr. In order for ROW to be vacated, the City must find there is good cause and Deer Valley must prove a net tangible benefit to the community - all of 84060 - not just nearby residents or visitors to the resort.

Over 1,100 households joined together over a year ago to form Protect the Loop (PTL) and they have not only provided public input, but provided an alternative plan which would allow Deer Valley to proceed with the Snow Park development but minimize the impact to local residents and provide net tangible benefit. Their comments and suggestions have been largely ignored and now the Council appears ready to approve the vacation. Consequently, they have started a petition.

As supporters of responsible resort development, we encourage everyone to read through the petition for additional details and sign in support of PTL.

Vote NO on current Deer Valley ROW Vacation Petition

As part of the legal process for placing the G.O. Bond for $30 Million for Recreational Amenities on the ballot, the City must hold public hearings and allow public input.

According to the Engage Park City page, the purpose of the bond is as follows: If the bond passes, proceeds may be used for fitness expansion at the PC Municipal Athletic & Recreation Center (PC MARC) and new recreation amenities at the PC Sports Complex (PCSC) at Quinn’s Junction, including indoor and outdoor pickleball courts, Nordic ski training area, a pump track for bicycles, refrigerated outdoor ice sheet, sports field lighting, and expansion of existing maintenance facilities.

This Thursday, October 5th is the first of two opportunities to participate with public comment. Regardless of which way one intends to vote, it's important the public be aware of this opportunity. The meeting starts at 5:30pm and it is the first item of New Business on the agenda. Attendance via Zoom is also possible. There is a 3-minute time limit per speaker although the Mayor has the authority to extend the time.

Other facts about the bond:
The Aquatic Facility and City Park Building are planned for renovation regardless of whether this bond passes.

The funds from the bond cannot be used for on-going or additional operation and maintenance expenses of the new or existing facilities. All staffing, maintenance, supplies, utilities and on-going costs will need to come from other sources within the Park City Municipal budget.

Good news for Park City!

After nearly four years of announcing its plans to develop the parking lots at the base of Park City Mountain, PEG Development President Robert Schmidt said the group is hanging it up and withdrawing its application.

PEG DEVELOPMENT WITHDRAWS APPLICATION TO DEVELOP THE PCMR BASE AREA!

It is with great joy and gratitude we announce that RRAD received word this morning the application for the development of the base has been withdrawn. This would not have happened without the strong support and work of our community! Your interest and participation in meetings as well as funds contributed toward our legal representation got us over this finish line. We also want to acknowledge the tireless efforts by our Planning Commission to properly review the staff reports and applicant’s presentations. Their public service to the community should not be overlooked on this or any application.

The development rights remain so RRAD will continue to be on the lookout for a new application. Any new application will be reviewed with the same critical eye. That said, we are encouraged by the communication and rapport that has developed between RRAD and PCMR’s COO Deirdra Walsh and her team. A well-designed and responsible project which adheres to the Land Management Code and benefits the entire community must be the shared goal.

Could the wait almost be over?

That’s how many days it has been since PEG Development appeared before the Planning Commission. Per the Land Management Code, the Planning Director may formally deny Applications, which remain inactive for a period of 180 days, or longer, due to acts or omissions of the Applicant.

We filed a GRAMA as we were skeptical as to the claim the application was still “Active” as required by the Land Management Code. Turns out our Planning Director found it necessary to inform PEG on December 16th in writing that in order for their application to remain active, they would need to make a ‘substantial submission’ by Monday, January 16, 2023. That was yesterday.

Today, on KPCW, the Planning Director stated there had been no new submissions made by PEG Development. If there truly has not been any substantial submission, then based on the contents of the letter, it appears PEG may request the application go to a vote as is or the application will be denied on February 21, 2023.

PEG Development wanted a vote back in the fall of 2022; perhaps they will now get one. Aren’t we all ready to get out of limbo and have a decision on this application which is requesting numerous exceptions to our City’s code and provides little to no benefit to locals.

However, we have remained in contact with the Planning Department to stay up to date on the next time we should expect to see PEG Development back in front of the Planning Commission for continued review of their PCMR Base Development application. The date remains undetermined.

During this lull, we discovered some code in our Land Management Code that we found to be of significance.

**February 16, 2022 – November 30, 2022 = 287 days
February 16, 2022 is the last date PEG Development (applicant) presented to the Planning Commission

**April 13, 2022 – November 30, 2022 = 231 days
April 13, 2022 is the last date the Planning Director made a statement to the Planning Commission on behalf of the PEG Development (applicant).

Additional support for our inquiry lies in the fact the PCMR Base Area Project page on the city’s website has not been updated since December 15, 2021…almost a year ago and PEG Development’s last complete submission found on this same page is dated November 11, 2021…over a year ago.

Why is this significant?
Per the Park City Land Management Code Section 15.1.14, an application may be denied by the Planning Director if it remains inactive for a period of 180 days, or longer, due to acts or omissions of the Applicant.

It would seem we have surpassed that 180-day mark and yet, both the Planning Director and PCMR’s COO have recently stated on KPCW the application remains active.

What constitutes active?
We’re not sure, but we’re digging into it for the answer. We have conferred with RRAD’s attorney, Nicole Deforge and she agreed it was worth the effort.
