BREAKING🚨🏳️🌈 Two men asked a San Jose State student if he was gay, then punched him in the head more than two DOZEN times while yelling slurs, prosecutors say.
It happened at 3:44 a.m. on Saturday, September 19, on the downtown San Jose State campus. The student was walking with two female friends when the two men passed them, asked him if he was gay, and started shouting anti-gay slurs, according to the Santa Clara County District Attorney's Office. The three of them ignored it and kept walking.
The men ran after him. Prosecutors say they knocked him down, punched him in the head more than two dozen times and kicked him, using the slurs the entire time.
One of his friends threw herself on top of him to take the blows. Prosecutors say the two men hit her too.
Campus police arrived while the attack was still happening and arrested both men as they ran, before they could get off campus. Security cameras recorded the whole thing. The student was treated at a hospital and released.
Josue Medina Flores, 19, of Sunnyvale and Christian Gabriel Nunez Petty, 20, of Fremont are charged with felony assault with hate crime enhancements. Neither attends the university. They appeared in court Wednesday, entered no pleas, and are being held without bail. They are due back October 7 and 8. The victim's mother spoke at the hearing and told the court she is afraid of what happens if they are released.
"They attacked him viciously without purpose," Deputy District Attorney Dan Okonkwo said. "These defendants didn't just harm the victim in this case. They also harmed the entire community."
District Attorney Jeff Rosen: "If you hurt someone because of their race, religion, gender, or sexuality, you will be arrested and prosecuted."
That office says this is the 14th hate crime case it has filed this year.
